A Trial Without Law is a Trial Without Legitimacy
Nigeria’s 1999 Constitution (as amended) is clear under Section 36(12) — no person shall be tried for any criminal offence unless that offence and its penalty are defined in a written law. This is a non-derogable constitutional safeguard, a cornerstone of due process, and a measure of any civilised nation’s commitment to justice.

A Motion on Jurisdiction is Not Delay:
When a defendant files a motion asking the court to decide its jurisdiction, the law requires the court to hear and rule on it before doing anything else.
Until that happens, the trial cannot move forward.
So, if the motion is still pending, it is the court’s failure to decide it, not the defendant’s insistence on his rights, that causes delay.
