🚨BREAKING: Australian Security Intelligence Organisation Amendment Bill 2.0 has passed in the Senate and will now become law.

26 YES, 15 NO.

Liberal Senator Alex Antic was the only Coalition member to speak against the bill.

The Greens and One Nation also opposed it, with Malcolm Roberts speaking against the bill. David Pocock also voted NO.

Only Labor voted for the bill.

One Nation’s attempt to remove ASIO’s power to question people for the “promotion of communal violence” failed.

The Greens and David Pocock voted against expanding questioning powers to cover serious threats from radical Islamic extremism.

Liberal Senators Jonathon Duniam and Maria Kovacic supported elements of the bill alongside Labor.

In March 2003, then-Labor frontbencher Anthony Albanese fiercely opposed Howard Government legislation expanding ASIO’s powers, quoting Nazi official Hermann Göring while warning such powers could be abused to suppress dissent and target innocent people.

His government has now made it law for ASIO to compel Australians to attend questioning. There is no right to silence.

Refuse to answer: up to 5 years in prison.

The sunset clause has been reinstated, with the powers due for review around August 2029.

Tomorrow is the day the Albanese Government and the Coalition team up to make ASIO’s compulsory questioning powers permanent.

“Debate” starts at 12.15pm at the latest, and at 1.15pm there’s a hard deadline to vote on the entirety of the legislation.

ASIO will be able to compel you to turn up and answer questions. There is no right to silence.

Refuse to answer, and it’s 5 years jail. Tell anyone it’s happening, and it’s 5 years jail.

There are 12 amendment sheets on this bill.

In summary:

The Coalition filed nothing. Not one amendment. On a bill expanding ASIO’s interrogation powers, the opposition asked for zero changes.

Labor reached a deal with the Liberal Party earlier this year to pass the legislation, agreeing to reinstate the sunset clause until mid-2029.

One Nation wants to add “serious threats from radical Islamic extremism” as a brand new ground for questioning.

The Greens have 8 of the sheets, and their opening move is a straight statement that the Senate should reject the bill and repeal the whole scheme as draconian.

Ban ASIO from compulsorily questioning anyone under 18.

Force ASIO to hand your lawyer a copy of the warrant, instead of your lawyer having to somehow know to ask for it.

Give your lawyer enough information to actually advise you on whether the warrant is even legal.

Delete ASIO’s power to throw your lawyer out of the room.

Delete the rule that stops your lawyer from speaking up or intervening during the questioning at all.

Will keep you updated on who votes for what once it’s all said and done tomorrow afternoon.
