We can beat around the bush about the different strategies to get around birthright citizenship but the reality is, there is only one viable fix.
Trump through executive order bans all immigration from third world countries today, under the powers given to him by Section 212(f) of the Immigration and Nationality Act. That gives you a 2 year immigration moratorium to figure out a better solution.
1) Sotomayor retires in that 2 year period. You replace her with a justice to the right of Clarence Thomas and then do what you can to try to force SCOTUS to change their decision from today.
2) You codify into law a permanent ban on immigration from third world countries. This would be the Hart-Celler repeal route. More difficult because of the traitors in congress.
3) You make birth tourism so dangerous and difficult that people stop taking the risk. ICE in hospitals. Pregnancy tests for visitors. Mandatory detention outside of US Borders etc etc. There is a lot you can do to slow the wheel.
4) Get rid of temporary visas like the H-1B visa. These are one of the largest causes of anchor babies. Indians come here on H-1Bs plop out a few kids, then the kids become citizens and sponsor the parents. It's a complete scam and needs to be removed by congress.
Anything else is just wish casting.

There are also tons of ways that birthright citizenship could be neutered right now:
- Make it impossible for foreigners to come here. Abolish all visas save for short business/vacation trips. The Trump administration is already doing this by massively curtailing legal immigration.
- Automatically refusing entry to pregnant foreigners. Require women visa applications to testify that they are not pregnant. Inspect them at the border. If you see a baby bump, deport them.
- Institute a residency requirement for holding public office, serving in the military, working for the civil service, or working for defense contractors. You must have been resident in the U.S. continuously for 18-25 years to hold any of these positions. Some countries already do this (e.g. Russia requires presidential candidates to be resident in the country for 25 years). Enjoy your birthright citizenship, Ramesh and Wang! You can't do anything with it.
- Ban dual citizens (and children of non-natural-born citizens) from holding the aforementioned positions. If you hold a green card from another country (e.g. India doesn't allow dual citizenship, but issues a visa to nationals who take foreign citizenships that is basically citizenship in all but name), you're also banned under this provision.
- Create tiers of citizenship. Birthright citizenship is the lowest tier and basically gives you nothing. You need to earn your way into higher tiers (as well as pass stringent security checks) in order to get rights like voting, holding public office etc.
- Militarizing the border. Alligator-filled moats. Automated gun turrets. Are you gonna risk jumping the border when CBP's Palantir-powered drones will automatically turn you into torta chutney?
Do you think the Trump administration didn't already game this out? Their actions now are the product of being out of power for four years, thinking about where they went wrong in Trump 1.0. We've seen massive wins on trade and immigration in the courts, legal immigration has dropped so precipitously that we now have net negative migration, illegal immigration is basically zero, deportations have never been higher. They are already implementing plans to make birthright citizenship worthless for foreigners.

The birthright citizenship case loss was not a huge defeat because it was never going to win at present. I’m not making a political comment. I’m making a legal comment. SCOTUS was never going to toss out 150 years of common understanding, based on a relatively recent critique. It’s going to take time.
But we got closer than we had any reasonable expectation of getting, with a 5 to 4 recognition that the 14th Amendment does not require birthright citizenship is currently understood.
This can’t be rationally considered a defeat. Instead, this is a step towards eventual victory. It is inevitable that, like all other first world countries, except Canada, we’re going to revise the notion of citizenship to reflect current reality.
It didn’t happen today, and it wasn’t going to happen today. But what you need to understand is this was a huge step forward towards eliminating birthright citizenship.
Don’t freak out; a few more defeats like this and we will have won.

It’s not an exaggeration to say this could be the most important decision in our lifetimes.
Under the current interpretation of the 14th Amendment, a foreign citizen of another nation can cross our border illegally at 9 months pregnant, give birth to an American citizen, and then return home. Their child is now eligible for US benefits and can vote in our elections.
The Chinese can also pay to have surrogate children on US territorial islands in the Pacific, then immediately ship the babies to China to be raised under the CCP. Those children are now eligible for US benefits and can vote in our elections.
Both of these scenarios are happening. It’s simply wrong and not at all what the Amendment was intended for, which was former slaves and their children during Reconstruction.
If it stands, US citizenship means nothing.
Wait, were colonial settlers just illegal immigrants fleeing harsh conditions for a better life? And are natives simply supremacists who were afraid of diversity?
What about all the entrepreneurs that risked everything and failed ?
Or the ones that are grinding it out, trying to build a business ? You know, the ones that create more than 60 pct of the new jobs in this country.
The more successful they are, the more you hate them?
Take their money so they can't invest in other founders? Or invest in causes they believe in ?
And the ones that fail and get to deduct 3k a year of their losses ? Or went for it and are broke and might never see enough income to offset those losses ? You don't care if they go broke ?

There are plenty of discussions to be had about income inequality. About helping people who are struggling economically.
I've talked about a lot of them in my timeline.
But in reality, saying "Eat the rich" will end up helping no one except maybe politicians trying to raise money. And probably hurt those in need, as more money is spent playing politics then helping
Wealth tax. Unearned income tax. Show me the multi year behavioral analysis, as opposed to simple models, that show more jobs, higher wages and personal wealth will be created for those who need it. I'd love to read them
Ideology is not a strategy. Nor is it a plan that has lasting impact on people who need help

I am a believer in trickle up. Where we do all we can get to get appreciable assets and higher wages into the hands of people who have to live paycheck to paycheck. I've said before I think raising the federal minimum wage to $20 is smart. When I heard people who worked for a company I invested in (but didn't run) needed government assistance, I made sure they all got raises. It was embarrassing to me that we didn't pay enough. I've made, or helped make, at least a thousand millionaires. And I'll keep working to increase that number
And that's the point.
The best path to help more people is to work with the people that can help more people.
If you demonize business people , you just make it harder for them to help anyone.
I'm not saying there aren't greedy, blood sucking business people that will do anything for a dollar.
But they are a small minority. Most entrepreneurs realize they are blessed. They want to find ways to help. They think they can use the same skills that built their business to help people.
And they can. They can hire more. They can give raises. They can educate. And they do all these things to help.
I've sat with Democrats and Republicans, incumbents and candidates,and asked them why they aren't meeting with businesses that make and sell the products that have become unaffordable, and asking them what can be done to reduce prices.
I do this continuously regarding healthcare. It's easy to see where the friction and increased pricing is coming from. Why (the politicians ) aren't you meeting with them and asking them to change ? Offering to support those that do raise wages, lower prices , improve benefits. Politicians just won't do it. They prefer the donations.
I did shark tank for 15 years purely to show people they can start small, grow their businesses, and help not only themselves, but their employees and their communities as well. And thats exactly what has happened.
Demonizing those that have success is counterproductive to every benefit you want to help bring to people.
Did you know that China is over 3,000 years old? and Egypt is over 5,000 years old? and America? the United States of America is not even 250 years old yet and we're still at the motherfucking top, bitch. The unreasonable hatred of Trump is causing many people to be unable to understand basic things. I really thought after 11 years of this people would wise up understand most of the lies the legacy media push and be happy with the wins even if they disliked the person giving them the wins, but it seems many would rather lose than acknowledge a win they championed their entire lives if it was brought to them by Trump. Sad state of affairs.
If remigrating large numbers of people to their homeland is ethnic cleansing then surely large numbers of people immigrating to someone else’s homeland is too.
