@rayway_eth @realrippoff @yugalabs Billion dollar brand that has been exclusively using brand name + logos for over a year on million dollar NFTs, brand partnerships, & physical merchandise has no enforceable trademarks? @realrippoff @rayway_eth @yugalabs Oh btw—while artistic fair use is a broad exception… defamation is a HUGE exception to that exception. Ryder may be precluded from asserting fair use because of this. Anyway, these questions are all what lawsuits are meant to answer. Hence, the filing of it.

@realrippoff @rayway_eth @yugalabs Ok. How does that chance the “intent” of Yuga in filing the lawsuit? They have a trademark, they want to assert it. So they can. Trademark fair use is an EXCEPTION to trademark law (Lanham Act). An affirmative defense. That’s what the 1A protects.

@ijhammer @yugalabs @ryder_ripps It’s not that rights are unresolved, it’s that they don’t want to highlight their poorly drafted license that, at face value, tells token holders they “own” their ape & full copyright—when in reality, they have legal right to very little.
