Why is his nationality relevant to the story?
Conditional discharge means he doesn’t go to prison, unless he breaks a condition. So how is this hypothetical rapist being released early to “make space for James”?

This is harsh.
James Brooke, a 43 year old British man, and father of two was driving one day when he pulled across a yellow box junction in London and his back wheels remained in the box.
He appealed the fine and lost. The traffic adjudicator, Carl Teper, decided that he was in the wrong and should be punished. I have to say, this was a harsh ruling.. Any car from the left would be able to get out and turn right freely.
James was a bit angry about this.
He sent an email to Teper saying he would blow up his office. He obviously did not mean it but he admitted sending the message in anger.
Yet he was given an 18 month conditional discharge. If he does anything wrong in the next 18 months he could be put in prison.
Meanwhile, actual abusers and criminals are being set free early to make space for people like James.
And you really hate that you can’t really fault any of the black characters or find flaws in their reasoning, and their disdain for Hal is justified despite him not doing anything to them directly or intentionally. And it’s an uncomfortable reminder of your own lives.

Half the community thinks giving John Stewart a "Tiger Woods" origin where his dad obsessively trained him to reclaim the ring makes his character ten times deeper, while Hal Jordan fans are mad that DC made Hal a default pick who only got the ring because someone else admitted to being scared.
