The Labor Department’s Office of Inspector General Anthony D’Esposito announced the investigation describing it as one of the most aggressive actions in history against foreign labor fraud.

Investigators are examining abuse of the H-1B and PERM visa systems, including schemes where employers and labor brokers turned in fake applications, used wage-kickback arrangements, and took jobs from American workers by hiring lower-wage foreign labor.

D’Esposito said that whistleblowers have revealed that some of the biggest companies in the program are committing the most fraud.

The Labor Department is working with the DOJ and the fraud task force to root out the fraudsters.

This comes after years of Republican criticism that the H-1B program, meant for specialty occupations needing highly skilled workers, has been used to import cheaper labor and sideline qualified Americans.

H-1B visa numbers by fiscal year (approvals and selections; note that total approvals include many renewals/extensions beyond the annual cap):

🔺️FY 2022: 442,425 total approvals
🔺️FY 2023: 400,000+ total approvals.
🔺️FY 2024: 400,000 total approvals
🔺️FY 2025: 442,000 unique beneficiaries plus over 120,603 selected in lotteries.
The statutory cap is 65,000 new visas per year plus 20,000 for U.S. advanced degree holders, though exemptions and renewals drive higher total numbers.

➡️Apple's Tim Cook laid off hundreds while approving as many or more new H-1B workers .
