‘THE THREAT WAS REAL AND ACTUAL’

NBI BARMM Regional Director Atty. Jeremy Lotoc testified during the fourth day of Vice President Sara Duterte’s impeachment trial that the alleged threat against President Ferdinand “Bongbong” Marcos Jr., First Lady Liza Araneta-Marcos, and former House Speaker Martin Romualdez was “serious” and “real and actual.”

I know that Tito, Vic, and Joey are men of compassion. The contributions they made to the society, both public and in private will bear them out.

But the issue today is not merely about compassion. Rather, it is forgiveness anchored on justice and accountability.

Mr Yllana did not merely put the careers of Tito, Vic, and Joey in jeopardy. He also tarnished the reputation of Senator Tito Sotto through his accusations— all because of his fanatical political support for the Dutertes.

He must face the consequences of his actions. Every wrongful act carries legal consequences, for the law is the foundation upon which accountability rests. If he seeks forgiveness, he must first accept and endure the consequences necessary to satisfy the demands of justice.

Forgiveness does not negate accountability. Without consequences, justice is diminished, and the likelihood of repeating the same conduct only grows. Justice must come first; only then can forgiveness have its true meaning.

‘WHO CAN AUTHENTICATE THE VIDEO: ME’

Former presidential spokesperson Harry Roque said that he is among the individuals who can authenticate the video related to Vice President Sara Duterte’s November 2024 alleged grave threats, as he was the one who broadcast it on Facebook.

During the second day of Duterte’s impeachment trial on July 7, NBI Senior Agent John Mark Calilung took the witness stand as the prosecution’s first witness and authenticated the videos.

Roque, in a separate statement, said the cross-examination showed that Calilung was not “presented or qualified as a digital forensics expert” or a competent witness to authenticate the video.

Roque, who left the country in 2024, has since been declared a fugitive after the Angeles City Regional Trial Court’s Branch 118 ordered his arrest in May last year on human trafficking charges in connection with his alleged involvement with Lucky South 99. #VPonTrial

เด็กโดนขังจนต้องขูดเศษผนังมากิน แต่อัยการไม่อยากทำคดีนี้ มองว่าคนใบ้สมองไม่รู้เรื่อง และไม่เห็นแสดง ‘เสียง’ เพื่อขัดขืน

ในปี 1961 ที่เมืองควังจู มีการก่อตั้ง โรงเรียนควังจูอินฮวา โรงเรียนสำหรับผู้บกพร่องทางการได้ยิน เป็นพื้นที่ของเด็กๆ ผู้ที่พิการทางการให้ได้ใช้ชีวิตปกติ อยู่กับเพื่อนๆ ที่สื่อสารภาษามือด้วยกัน ฟังดูเหมือนสวรรค์น้อยๆ แต่ความจริงที่นี่คือนรกบนดิน

โรงเรียนนี้เบื้องหลังคือธุรกิจครอบครัว เป็นมูลนิธิ ประธานมูลนิธิให้ลูกชายคนโตมาเป็นผู้อำนวยการโรงเรียน และให้ลูกชายคนรองเป็นฝ่ายบริหาร ให้ลูกชายอีกคนเป็นรองครูใหญ่ ให้ญาติมาช่วยทำ เวลาใครทำอะไรผิดเลยช่วยกันปกปิด

เด็กถูกครูมองว่าไม่ใช่คน เพราะพิการ หลายครอบครัวส่งลูกมากินนอนที่โรงเรียนนี้ หลายคนเป็นเด็กกำพร้า อีกหลายคนมีอาการพิการอย่างอื่นด้วย เดินไม่ได้ เด็กๆ ตกอยู่ใต้อำนาจผู้ใหญ่ใจร้าย ครูที่นี่ไม่ได้มีความสงสารเห็นใจเด็ก ดูถูก ทุบตีนักเรียน ตัดผมเด็ก บูลลี่ ล้อเลียนความพิการ เด็กถูกทำร้ายจิตใจไม่เว้นแต่ละวัน

ครูเลือกเด็กแล้วจับรุมโทรม ข่มขืนจากรุ่นสู่รุ่น จับทำสิ่งวิปริตตามอำเภอใจ เช่น สั่งให้เด็กแก้ผ้าเพื่อเป็นแบบวาดรูป จับเด็กขังให้หิวจนเด็กต้องขูดเอาสีบนผนังมากิน จับแกล้งทรมาน เด็กโดนมัดติดกับเครื่องทำความร้อนในห้องน้ำ ให้อดอาหาร ลงโทษด้วยการจับจูบ ให้ดูหนังโป๊ ให้เด็กด้วยกันทำร้าย บางคนถูกฆ่าหมกป่า คนภายนอกไม่รู้เรื่องก็เอาเงินมาช่วยบริจาค ไม่รู้เลยว่าเงินเข้ากระเป๋าผู้อำนวยการและญาติ มีการคาดการณ์ว่าเงินอุดหนุนและบริจาคปีเดียวมีมากถึงสองพันล้านวอน (สี่สิบล้านบาท) แต่สภาพโรงเรียนไม่มีการพัฒนา เพราะเงินถูกเอาไปใช้ส่วนตัวหมด

เด็กอยู่ในสภาพจำยอม หนีไม่ได้ หลายคนไม่มีบ้านให้กลับ พ่อแม่ลำบากเป็นผู้พิการเหมือนกัน ฟ้องใครก็ไม่ได้เพราะพวกเดียวกันหมด เด็กโดนครูบังคับให้ยกโทษให้คนที่ข่มขืนตัวเอง บังคับให้เซ็นเอกสาร ครูที่จะช่วยเด็กโดนไล่ออก โดนอำนาจมืดรังควาน อะไรเหี้ยๆ มีที่นี่หมด

ปี 2005 มีครูคนใหม่ ครูสังเกตเห็นว่า เด็กคนนึงเดินแปลกๆ ไปถามจนรู้ว่าเด็กโดนข่มขืน ครูเอาเรื่องนี้ไปฟ้องแต่ถูกไล่ออก ครูพาเด็กไปศูนย์ช่วยเหลือ เป็นจุดเริ่มต้นแฉด้านมืด มีสื่อมาทำข่าว เหยื่อออกมาประท้วง พวกครูเลวเอาเอกสารที่เด็กโดนบังคับเซ็นว่าไม่ได้โดนทำร้ายมาอ้าง จับเด็กให้พลิกคำพูดว่าสร้างเรื่อง เด็กไปแจ้งตำรวจ แต่ตำรวจทำงานช้า อัยการไม่สนใจทำคดี มองว่า ผู้พิการชอบสับสน ให้การกลับไปกลับมา คดีถูกยืดเยื้อจนกว่าจะสั่งฟ้องก็ผ่านไปหลายเดือน

มีการบุกจับพวกครูและผู้อำนวยการ พวกครูโดนรอลงอาญาปล่อยมาอยู่อิสระ กลับไปสอนปกติ จะมีที่ลงโทษจริงจังหน่อยก็คือผู้อำนวยการที่ติดคุก 10 เดือน ติดน้อยมากเทียบกับสิ่งที่เกิดขึ้น

นักเขียนชื่อ กงจียอง อ่านข่าวเรื่องนี้แล้วเกิดแรงบันดาลใจเขียนนิยายเรื่อง ‘เดอะ ครูซิเบิล’ หลังจากหนังสือตีพิมพ์ มีนักแสดงเกาหลี ‘กงยู’ ได้อ่านตอนเข้ากรมทหาร อ่านจบรู้สึกคับแค้นใจมาก เขารู้สึกต้องทำอะไรซักอย่าง ติดต่อนักเขียน ติดต่อผู้กำกับมาสร้างหนัง ติดต่อนายทุน ตอนแรกนายทุนไม่อยากสร้างเรื่องนี้ เพราะมันหดหู่ กลัวขายไม่ได้ ผู้กำกับที่ยอมมารับงานคือ ฮวังดงฮยอก ผู้กำกับสควิดเกม แล้วหนังของคดีนี้เลยเกิดขึ้น

หนังนำแสดงโดยกงยู มีนักแสดงเด็กที่ฝึกภาษามือมาโดยเฉพาะ ผู้กำกับใช้เทคนิคการถ่ายทำแยกส่วน ไม่ให้เด็กถ่ายทำร่วมกับผู้ใหญ่ในฉากรุนแรง พอฉายในปี 2011 กลายเป็นปรากฏการณ์ คนดูทั้งประเทศ ประธานาธิบดีเกาหลียังไปดู จุดกระแสให้คนเรียกร้องให้มีการรื้อฟื้นคดี และมีพยานลับคือ คนขับรถโรงเรียน ที่ทำงานในโรงเรียนมา 20 ปี เขียนบันทึกทุกอย่างไว้ คนดูหนังจบก็ร่วมลงชื่อเรียกร้อง สุดท้ายผู้อำนวยการเลยติดคุกเพิ่มเป็น 12 ปี และโรงเรียนก็ถูกสั่งปิดในปีที่หนังออกฉายปีเดียวกัน

ภายหลังมีการผ่านร่างกฎหมายโทกานี ยกเลิกอายุความสำหรับคดีอาชญากรรมทางเพศผู้พิการ (เท่ากับผ่านไปกี่ปีก็นำตัวคนร้ายมาลงโทษได้) ให้การเอาผิดคนร้ายล่วงละเมิดผู้พิการ ไม่จำเป็นต้องพิสูจน์ว่าเหยื่ออยู่ในภาวะที่ไม่สามารถขัดขืนได้ ไม่มีการอ้างว่าเหยื่อส่งเสียงมั้ย ขยับตัวมั้ย คนพิการโดนล่วงละเมิดก็คือโดนล่วงละเมิด

หนังหรือหนังสือสามารถเปลี่ยนแปลงสังคมได้ กงยูให้สัมภาษณ์ว่า หลังอ่านหนังสือเรื่องนี้จบ เขายังไม่อยากจะเชื่อว่าเป็นเรื่องจริง แต่พอรู้แล้ว เขาเลยถามตัวเองว่า ในฐานะนักแสดง เขาทำอะไรได้บ้าง เขาเลยตัดสินใจทำหนังเรื่องนี้ เพราะเชื่อว่ามันจะเข้าถึงผู้คนได้มากขึ้น เสียงของเขากลายเป็นเสียงที่เปล่งออกมาแทนเด็กๆ และเปลี่ยนโฉมกฎหมายเกาหลีที่มีต่อผู้พิการไปตลอดกาล
