In the landmark case of Coca Cola East & Central Africa Ltd v Maria Kagai Ligaga [2015] eKLR, the Court of Appeal of Kenya firmly established the legal foundation for constructive dismissal in employment law.
The Court held that an employee may lawfully resign and claim unfair termination if the employer commits a fundamental breach of the employment contract—such as creating an intolerable work environment, undermining the employee’s role, or engaging in sustained unfair treatment. In such instances, the resignation is not voluntary but is legally treated as a dismissal by the employer.
This case adopted the "contract test," aligning with international precedent, and emphasized that for a claim to succeed, the breach must go to the root of the employment contract, leaving the employee with no reasonable alternative but to resign.
