Poor, poor Brian.

In the early days of Coinbase, they were desperate to be accepted by the system, implemented KYC without a legal pretext and totally swallowed the Kool-Aid that bitcoin was money and Coinbase was a "FinTech".

Had he known a little Internet history, he might have chosen a different tactic.

Skype was attacked in the same way that Coinbase and other bitcoin companies are being attacked.

Skype managed to see off the attackers by classifying themselves as something other than a "Telephone Service", so that all the telecoms laws didn't apply to it.

As soon as they did this proper classification of the Skype service, they were free from telecoms regulation (and in some cases where telephony was a state monopoly not free from regulation but free from being stopped altogether). This what I have been arguing for from the earliest days of Coinbase.

Bitcoin is literally not money, in the same way that Skype was not a telephone service, and WhatsApp is not a telephone service or telephony company. All the telephony companies you care to mention are still operating, even state monopolies, and WhatsApp is there for anyone who wants it. Which is over 3 billion people.

The fundamental error Brian made is now going to haunt him forever. He is going to fight regulation that he asked for himself, rather than acting like a real American, like Travis Kalanick.

Uber is not a taxi company
AirBnb is not a hotel company
Skype is not a telephony company
Bitcoin companies are not banks or fintechs
Email companies are not Postal Services

This was obvious to me in 2012, but not obvious for Goldman Sachs refugees who look at the world through the wrong end of the telescope.

This is a direct response to France classifying X as an "organized gang," the same legal designation they use for drug cartels and mafia, so they could wiretap employee phones and demand algorithm access.

The EU wants control over what people see online. They fined X $140 million last month, launched probes into "algorithm abuse," and demanded researchers get data access. France wants "experts" to analyze X's code to "uncover the truth" about the platform.

Elon's response: "You want the algorithm? Here's the algorithm. Everyone gets it."

This is 4D chess. EU regulators wanted private access to modify and control.

Instead they're getting public disclosure they can't manipulate. Every competing platform, every researcher, every government on Earth gets the same code at the same time.

You can't secretly pressure someone to censor when the censorship mechanism is open source.

My prediction: EU loses its mind, threatens more fines.

Elon doesn't care. Other platforms forced to follow or look like they're hiding something.

Every day that passes without a pardon for the Samourai Wallet developers is another day that @realDonaldTrump's administration validates a perverse legal theory that an entity can be an unlicensed money transmitting business under US 18 1960(b)(1)(C) while simultaneously NOT being an unlicensed money transmitting business under US 1960(b)(1)(B). Keonne is beginning this new year in the confines of a prison, serving a 5 year sentence for a crime he did not commit. Meanwhile, Bill is preparing to turn himself in tomorrow, facing his own 4 year sentence. This somber start casts a shadow over this upcoming year.
