President Macron said today that the attack on Iran did not respect international law. Under the UN Charter, a state cannot use force against another state except in self-defence or with authorization from the UN Security Council. In practice, however, the Security Council is now largely paralysed by veto powers.
There is also the Responsibility to Protect (R2P), developed after Rwanda and Srebrenica, which recognizes that sovereignty implies a duty for states to protect their populations from mass atrocities. If a regime commits large-scale crimes against its own population and fails in that responsibility, the international community is supposed to act.
The problem is that in today’s geopolitical environment, the mechanisms that should enforce these norms rarely function. So we end up invoking international law even when the institutions meant to uphold it cannot realistically act.
International law should not become a shield behind which regimes committing mass atrocities can hide. Its purpose was never to protect dictators or terrorists, but to preserve international peace while protecting human life.
