In appeals court fight over the White House ballroom, DOJ says the federal government could quickly bulldoze the statute of liberty and no one would have standing to sue over the changes once the demolition is done.
JUST IN: DOJ apparently for the first time indicates in writing that it is not moving forward with the "anti-weaponization fund."
In a new court filing, the DOJ says the Court should not grant a bid to block the fund-- "not because the Fund will continue (it will not), but to protect the government’s institutional interests in the proper application of Article III limitations on judicial review." @MSNOWNews
An appeals court is now weighing a decision on whether construction should be allowed to continue on President Trump's controversial White House ballroom project.
@falgallagher shares more on what she heard inside the courtroom.

Todd Blanche's name appears 96 times in Pam Bondi's House interview about the Epstein files. Variations of telling the committee that he was in charge of the entire effort. https://t.co/8JORBrxG8h

BREAKING: SCOTUS grants Alabama's emergency bid to use its never-before-used Congressional map, which cuts one of the state's two majority-Black districts.
This 6-3 ruling comes after the district court recently ruled this map intentionally discriminated against Black voters. @MSNOWNews
BREAKING: During House subcommittee hearing, Blanche says, “We’re not moving forward with the fund. Period.”
The acting attorney general appeared to catch Rep. Grace Meng, D-N.Y., off guard with his repeated disavowal of the $1.776 billion “anti-weaponization” fund that has drawn fire from Democrats and Republicans alike.
Meng pushed the attorney general to clarify whether he meant only until the temporary injunction lifts on June 12. Blanche affirmed, “We’re not moving forward with the fund.”
Blanche’s testimony appears to mark the first time the administration is publicly dropping its plans for the fund in a definitive way. @MSNOWNews
LIVE: Acting AG is back on the Hill to testify before a House subcommittee. He already made news when he said definitively the DOJ is "not moving forward" with the $1.776 billion "slush fund" -- despite a court order that has temporarily blocked it.

Folks the court did NOT rule that the fund is dead. She only ruled that for a two-week period the fund would be on pause while the judge could sort through the legal issues. Abiding by the court order does not mean killing the fund.
In a 2-1 ruling, the DC Circuit says the Pentagon's transgender ban is based on animus and likely unconstitutional for service members who have already enlisted. The ruling does not apply to transgender individuals who may enlist in the future.
BREAKING: An appeals court ruled that the Pentagon's ban on transgender service members is likely unconstitutional.

JUST IN: In Comey adjacent news, a federal judge in Washington is allowing protesters to continue to fly "8647" flags on the National Mall. Judge Ross said these signs do not represent a "true threat on the life or physical wellbeing" of POTUS.
This ruling comes as Comey has been charged with threatening the president for posting a photo of sea shells arranged to spell "8647" on the beach. @MSNOWNews
Petracca's replacement is a prosecutor named Timothy Severo. He appears to have decades of prosecutorial experience-- at both the state and local level.
But most of his work seems to focus on drug trafficking crimes. Back in 2006, when he was in the DA's office, he was cross-designated as a Special AUSA specifically to go after drug offenders.

JUST IN: EDNC informs the judge overseeing the Comey "sea shells" case that it is removing Matthew Petracca as the government's counsel for the case.
Petracca is the AUSA who secured the indictment against Comey.
They are substituting him with another AUSA. No reason was given for the substitution.
