That family trust deed sitting in a drawer may soon count for nothing in law, unless it is registered.

The new Trust Administration Bill, 2026 would make registration a condition of a written trust’s validity. An unregistered deed would generally be inadmissible in any dealing with the property it relates to, no longer weak evidence, but no evidence. It also brings default irrevocability for silent deeds, a beneficial ownership register, criminal liability for some trustee breaches, and an override of broad exculpation clauses, even for trusts made decades ago. Existing trusts get 24 months to comply, and the clock will be the only warning most receive.
