In my view, Justice Swarana Kanta Sharma should have recused herself from the Delhi excise policy CBI appeal on moral and ethical grounds, even if the court held it was not legally mandated.

Her son (Ishaan Sharma, Group ‘A’ panel counsel at the Supreme Court) and daughter (Shambhavi Sharma, Group ‘C’/Government Pleader) are empanelled as Central Government counsel. They receive professional fees for briefs allocated through the Solicitor General’s office, the same SG who appears for the CBI before her.

In 2009, Justice R.V. Raveendran suo motu recused from the high-profile Mukesh Ambani vs Anil Ambani gas pricing dispute because his daughter was associated with a law firm that advised the Mukesh Ambani group in other matters. There too, the link was only in “other matters,” yet he chose caution.

Here, the family’s professional income flows from the prosecuting side. To uphold the highest standards of judicial impartiality and ensure justice is manifestly seen to be done, recusal would have been the morally wiser course. Public trust in the judiciary demands more than the bare legal minimum.

Her name is Rita Kaushik.

She was the Principal Family Court Judge in Jaunpur Uttar Pradesh.

In December 2024 Atul Subhash named her in his 81 minute video and 24 page suicide note.

He alleged she demanded Rs 5 lakh bribe for a favourable verdict in his case.

He alleged a court clerk demanded Rs 3 lakh just to schedule hearing dates.

When he refused the alimony order came. Rs 80,000 per month.

Atul Subhash died on December 9 2024.

No FIR was filed against Rita Kaushik.

No inquiry was ordered.

On June 6 2025 she was promoted to District Judge.

Atul Subhash’s case is adjourned to November 2026.

The accused in his death are on bail.

The judge he named is now a District Judge.

This is the system Indian men are fighting.
