I was reading some PhD Thesis the other day, as is my wont, and noticed this declaration in the front matter with the author's signature:
"I, the undersigned, declare that I am fully aware that plagiarizing documents, or any part of a document published in any form, whether digital or printed, constitutes a violation of copyright as well as an act of academic fraud. Consequently, I undertake to cite all sources that I have used in writing this thesis."
Whoever wrote the university's plagiarism notice doesn't even understand copyright law.
It is in fact not the case that plagiarism necessarily "constitutes a violation of copyright". First: is is not "plagiarizing documents" that "constitutes a violation of copyright". It is REPRODUCING documents under copyright that is infringement.
And not all plagiarism violates copyright. What about an old work, for example, or a policy manual produced by the federal government? All are public domain. So if the author of a thesis were to reproduce several pages of, I dunno, say, Chaadayev https://t.co/HZkpgN1gmc and presents it as his own, that's still plagiarism, but it is not copyright infringement. On the other hand, suppose the thesis includes the entire text of Dune but surrounds it with quotation marks and gives citation and attribution to Herbert. That is not plagiarism at all, but it would still be copyright infringement. Copyright and plagiarism have nothing to do with each other.
Copyright also has nothing to do with attribution or credit. It's still copyright infringement even if you give credit. It has nothing to do with fraud, dishonest, lying, or contract breach either.
The person who crafted this plagiarism pledge wording is under the confused belief that plagiarism, fraud, copyright, contract are all sort of the same thing. This is sloppy and lazy. Moreover, the plagiarism declaration states that it would be: "an act of academic fraud". Lying and breaching university academic policy is not actually fraud in the legal sense (sigh. look it up), so I guess they have in mind something different here, something called "academic fraud" which is not defined and is apparently different from real fraud. So why use the word fraud?
