A public admission by a sitting Member of Parliament that money was used to influence the outcome of such proceedings is profoundly disturbing. If true, it calls into question not merely the integrity of the impeachment of H.E. Rigathi Gachagua, but the institutional credibility of Parliament itself.
A constitutional process tainted by bribery ceases to be an exercise in democratic accountability and instead becomes an assault on the rule of law.
These allegations warrant a thorough, independent and transparent investigation. Constitutional offices cannot be filled or vacated through the currency of bribery
Obado Guilty!
Lady Justice Cecilia Githua has found former Migori Governor Okoth Obado guilty in the Sharon Otieno murder case.
For Sharon's family, today's judgment may offer a measure of justice and accountability after years of waiting. May they continue to find strength as the legal process unfolds.
The Law Society of Kenya has taken a bold and commendable step to call for judicial accountability. Corruption is undoubtedly a major malaise that has slowly eroded trust in our judicial system, and it must be addressed one way or another. However, LSK should lead us to engage in some self-introspection.
1. Can corruption in the judiciary exist without the participation of lawyers?
2. If it is wrong for a judge to obtain orders to stop an inquiry by JSC ? Should LSK publish a list of lawyers who accept instructions to represent the mentioned judges?
3. What about judges who issued the orders; should we not shame them as well?
4. It takes two to tangle; what about lawyers who file cases in Court and bribe judicial officers to get a favorable decision? Shouldn’t we have a list of shame for these lawyers as well?
5. In 1994, 37 prison warders died in a road accident. A Nairobi lawyer, Kamau John Kinyanjui, was paid Kshs. 52 million in compensation for the families but stole the money. LSK didn’t take any action. The trend has continued. How many Kenyans continue to suffer at the hands of rogue lawyers? Why is LSK silent? What is LSK doing to reform the legal profession?
6. There are hundreds of cases pending in the Advocates Disciplinary Tribunal involving theft of client money. Will LSK publish the list of lawyers with pending disciplinary cases and ask members of the public to boycott them? How far is LSK willing to take this conversation ?
