Or does Anwar mean, that he had left the matter entirely to the rulers to decide on the right candidates? Which is it? In order to shut down public criticism, Anwar appears to be creating a perception that he had left the matter entirely to the Rulers.
3.But it should be remembered that Art 122B of the Constitution states that judges are appointed by the King upon the advice of the PM, and pursuant to Article 140(1) the YDPA “shall act in accordance with the PM’s advice”. In other words, the King and conference of rulers are bound to accept “the advice”. They have no discretionary power to decline the PM’s choice of judges.

9.The PM has also claimed that the judicial crisis was a matter of “perception”. This is an irresponsible and self serving statement. Were the explosive contents of the leaked JAC minutes mere “perception”.? Was the unprecedented delay in appointing top judges mere “perception”? Is the failure to extend the tenure of the respected and highly qualified former CJ Tengku Maimun mere “perception”?
10.Finally, why is the PM passing the buck to the Constitutional rulers who are in any event bound by the Constitution to accept the advice of the PM?
11.This crisis was caused by the actions, failures and conduct of the PM himself. He must take responsibility for causing this crisis and remedy the situation. Anwar and his government must, in this parliamentary session, amend the federal constitution to remove entirely the PM’s power to appoint the judges. Nothing else will allay public concern and end the judicial crisis.
