A snr counsel withdrawing from cases bcs of failure of bench to control repeated interruptions.
Fine.
But then, am also thinking of juniors who get hostile bench/seniors on opposing side everyday.
Then, young lawyers r told to be resilient & dnt take everything personally!
Just see the pathetic condition of the High Court. The judges don’t know what is Section 304 part I and 304 part II of the IPC! And you expect the judges to appreciate the evidence! This is not the first judgement we are coming across. These are all principles of law which law schools teach in the first year of academic session: Supreme Court on Chhattisgarh High Court
It is a matter of record that the Hon'ble Supreme Court did not uphold the rights and freedoms of citizens of this country when the govt declared Emergency. The ADM Jabalpur judgment remains a permanent reminder of how the highest court abandoned its constitutional mandate.
History is again recording how the court is silent and refusing to hold the govt or the police accountable for crushing freedoms of citizens. Democratic peaceful protests are being brutally suppressed in the capital at Jantar Mantar. People are out on the streets to ensure their right tovote.
Just one humble submission to constitutional courts from a mere lawyer, please don't express regret a few decades later. This is not a mistake, nor an inadvertent error, it's a considered decision.
Supreme Court Justice Dipankar Datta opens judgment with a poignant note for his late law clerk Ritwik Deswal, who died four days before his 27th birthday:
The order is in memoriam. Human life is fragile, yet in the ordinary course of living, we seldom pause to recognize just how fleeting it is. And when life finally confronts us with that fragility, the realization often comes too late. On that note, at the very outset, we begin on an unconventional premise. One of our dearest law clerks, cum research associates, Ritwik Deswal, left for his heavenly abode, four days short of his 27th birthday, which happens to be today. As we pronounce this judgment, which bears the quiet and indelible imprint of his final labors, we hasten to record our deep appreciation for the invaluable research assistance rendered by him in the build-up to the preparation of this judgment. His untimely demise has left an excruciatingly deep void in our lives. Even in his final hours, his thoughts remained firmly anchored in the pursuit of truth and the service of justice. It is therefore with profound personal sorrow and grief that we dedicate this final collaboration to his memory, his integrity, his indomitable commitment to the law, his love for academia, and his other great qualities of head and heart.
I had broken the story how DM Roopam's matter was allotted to the bench that doesn't have the roster for preventive detention matters. Now, it has emerged that student Akriti had infact earlier approached the Supreme Court to quash his detention which was before J Nagarathna.
Alan Norrie’s analysis of the famous Dudley v Stephens case (cannibalism at sea) is one of the best things you’ll read on the subject: a galaxy distilled into five pages of utterly lucid prose.
