UPDATE: Here’s what just happened with the emergency appeal in the Lindsay Clancy case:

The defense went to the Massachusetts Supreme Judicial Court asking Justice Dalila Wendlandt to stop the mistrial process and require Judge Sullivan to address the holdout-juror issue before this jury is discharged.
The defense’s argument is that this is NOT simply a juror disagreeing with the other 11. The foreperson reported that the juror had acknowledged doubt but refused to apply that doubt to the verdict as required by law.

Because of that, the defense is asking for an individual inquiry/voir dire to determine whether that juror is actually willing and able to follow the judge’s reasonable-doubt instructions.
The Commonwealth argued that this is part of jury deliberations and the court cannot start investigating a juror simply because the jury disagrees.
Justice Wendlandt heard both sides and has now TAKEN THE MATTER UNDER ADVISEMENT.

That means:
NO ruling yet.
The defense has NOT lost.
The defense has NOT won.
The mistrial remains on hold while the SJC decides what happens next.
If the defense wins, Sullivan could be ordered to question the juror before ending this jury.

If the defense loses, Sullivan can move forward with the mistrial.

We are now waiting on the Massachusetts Supreme Judicial Court.
