Review of Membership Terms and Conditions and Request for Consumer Protection Measures

In June 2026, the Korea Fair Trade Commission (KFTC) reviewed the terms and conditions of paid fan club memberships operated by 24 entertainment agencies and fandom platform companies. As a result, it required revisions to eight categories of unfair contractual provisions, including unreasonable restrictions on refunds, exemptions from service providers’ liability, and limitations on consumers’ exercise of their rights.

In particular, KFTC raised concerns about provisions that categorically exempted service providers from responsibility for providing services or compensating for losses, even in circumstances potentially attributable to the providers’ management responsibilities, such as an artist’s departure from a group.

KFTC also addressed provisions that vaguely defined the grounds for modifying or suspending services or allowed such changes to be implemented through general announcements alone. It required the grounds for such changes to be specified more clearly and individual advance notification to be provided when significant changes affect customers’ rights or obligations.

In light of the principles underlying these corrective measures, we request that the company review the membership benefits originally advertised at the time of purchase against the benefits actually provided, assess them in accordance with the applicable terms and conditions, and clearly communicate the results of that review and any subsequent measures for purchasers.

Furthermore, Article 11, Paragraph 3 of the Mnet Plus Terms of Service, operated by CJ ENM, stipulates that members shall be informed of the handling process and outcomes of their submitted opinions or complaints. Article 13, Paragraph 3 also establishes procedures for announcements and notifications concerning changes to or discontinuation of services.

Accordingly, we request that the company provide information regarding the handling status and review outcomes of both the inquiry submitted on July and this collective inquiry.

What fans ultimately wish to see is Kim Geonwoo returning to ALPHA DRIVE ONE so that all eight members can perform together once again.

We urge the company to end its prolonged silence and answer responsibly to requests concerning Kim Geonwoo’s return and other legitimate inquiries raised by fans who have continued to wait for him.

Should the company continue to fail to provide concrete responses and necessary information, we will consider further action, including filing a complaint with the Korea Fair Trade Commission (KFTC) and seeking consumer consultation through the Korea Consumer Agency (KCA).

<Request for an Official Statement Regarding Kim Geonwoo's Return to Activities and Response to Membership Service Inquiries>

We express our disappointment with the company’s handling of the current situation involving ALPHA DRIVE ONE and formally request an official announcement regarding Kim Geonwoo’s return to activities and the provision of membership services.

Kim Geonwoo has been on hiatus for over 6 months, since April 8, 2026. In response, comebackgw team submitted an inquiry regarding ALPHA DRIVE ONE membership services on the Plus Chat Customer Support Center back in July. However, we have yet to receive any response.

Responding sincerely and responsibly to inquiries from paid membership users is a fundamental obligation of a service provider. Continuing to operate a paid membership service while failing to respond to existing purchasers’ inquiries undermines trust in the service and may be perceived as deceiving consumers.

We therefore request an official announcement regarding the following two matters.

1. Disclosure of Plans for Kim Geonwoo’s Return to Activities

Providing no concrete announcement regarding Kim Geonwoo's future activities for over six months of ongoing hiatus is unacceptable. We urge the company to take responsible measures to facilitate Kim Geonwoo’s return to activities and promptly issue an official statement.

2. Notification and Appropriate Measures for Membership Purchasers Affected by the Prolonged Hiatus

Despite Kim Geonwoo’s hiatus continuing for over six months, no separate notice or guidance has been provided to membership purchasers regarding this situation.

Furthermore, the inquiry submitted in July remains unanswered, even as the Early Bird Membership period approaches its expiration on October 26.

We request that the company officially respond to the inquiry and promptly provide a detailed explanation of the measures it intends to take for purchasers regarding the membership benefits that were not provided during this period.

멤버십 약관 검토 및 구매자 보호 조치 요청

공정거래위원회는 2026년 6월 24개 엔터테인먼트사 및 팬덤 플랫폼사의 팬클럽 유료멤버십 이용약관을 심사하여 부당한 환불 제한과 사업자의 책임 면제, 이용자의 권리행사 제한 등 8개 유형의 불공정 약관 조항을 시정하도록 하였습니다.

특히 아티스트의 탈퇴 등 사업자의 관리 영역상 귀책으로 볼 여지가 있는 사유에 대해서까지 서비스 제공이나 손해에 대한 책임을 일률적으로 면제하는 조항을 문제 삼았습니다. 또한 서비스 변경·중단 사유를 추상적으로 정하거나 공지만으로 변경·중단이 가능하도록 한 조항에 대해서는 사유를 구체화하고 고객의 권리·의무에 중대한 변경이 발생할 경우 사전에 개별 통지하도록 시정하기로 하였습니다.

이러한 시정 취지를 고려해 구매 당시 안내한 멤버십 혜택과 실제 제공 내역을 적용 약관에 비춰 검토하고, 그 결과와 구매자 대상 후속 조치를 구체적으로 안내해 주시기 바랍니다.

또한 CJ ENM이 운영하는 Mnet Plus 이용약관 제11조 제3항에는 회원이 제기한 의견이나 불만사항에 대해 처리 과정과 결과를 회원에게 전달한다고 명시되어 있습니다. 제13조 제3항에도 서비스 변경·중단에 관한 공지·통지 절차가 규정되어 있습니다. 지난 7월 접수된 문의와 이번 공동 문의에 대해서도 처리 현황과 검토 결과를 안내해 주시기 바랍니다.
