#29Enero DEROGADA LA NACIONALIZACION Y SOBERANIA PETROLERA

Hemos tenido acceso al proyecto final de la ley que DEROGA la ley Orgánica de Hidrocarburos y que hoy se aprobará en la AN de manera express.
Anexo https://t.co/oIcUabPXTO un análisis sobre el texto final, donde se hacen 17 notas o comentarios para discutir la mayor regresión en nuestro régimen petrolero.
Efectivamente, se trata de la “erradicación” de la política petrolera de Chávez y, agregaría yo, de la nacionalización de 1976 y de todo el pensamiento nacional petrolero del país.
Evidentemente, la primera Reforma propuesta y que debía ser aprobada el martes pasado en la AN, no fue aceptada. Hoy , se presenta un proyecto final de “Reforma”, que DEROGA completamente, no sólo la nacionalización de 1976 que reservaba al Estado las actividades petroleras, sino la Nacionalización de la Faja Petrolífera del Orinoco de 2007, que nos otorgaba el control y manejo de la mayor reserva de petróleo del planeta. Esto borra de un zarpazo nuestras conquistas nacionales de casi 70 años y pretende cancelar el pensamiento nacionalista petrolero del país. Desde Pérez Alfonzo, pasando por CAP hasta Chávez, lo que nos retrocede a la época de Juan Vicente Gómez.
Además de la privatización de las actividades petroleras, tanto las primarias de producción, como las de exportación de petróleo, reservadas al Estado por el artículo 302 de la Constitución, se entregan los activos y derechos de PDVSA a los operadores privados, decretando el fin de nuestra empresa nacional, para convertirla en una mera agencia administradora de contratos.
Así, volvemos a la época donde el país tenía solo una nuda propiedad sobre el petróleo, se trata de la desnaturalización de la propiedad sobre nuestro principal recurso natural, sobre el cual, no tendremos manera de ejercer su control y manejo soberano.
Por otra parte, se entrega a los privados la comercialización del petróleo, también reservada al Estado por la Constitución, lo cual impide que Venezuela pueda fijar los precios y atender los mercados de acuerdo con nuestros propios intereses. Ahora será lo que decidan las transnacionales. Así, el peso de Venezuela en la OPEP será cada vez mas insignificante.
La ley derogatoria que será aprobada en la Asamblea Nacional incluye rebajas fiscales totales, es una claudicación de nuestros derechos como propietarios del petróleo. Se eliminó el monto mínimo de regalías, se eliminó el impuesto de extracción, se eliminó el impuesto a los precios extraordinarios y exorbitantes del petróleo, se eliminó la tasa mínima del impuesto sobre la Renta. El Ejecutivo se abroga una enorme discrecionalidad para favorecer al interés privado, en detrimento de nuestro pueblo.
Se incluyó el arbitraje internacional, cediendo nuestra soberanía jurisdiccional, en violación del artículo 151 de la Constitución. En la nueva ley derogatoria el Estado se compromete a compensar a las transnacionales si en el futuro se producen cambios en el régimen fiscal, impositivo o las leyes de la República, renunciando así a las potestades soberanas del Estado sobre el manejo de nuestros propios asuntos.
Igualmente, se arrebata a la Asamblea Nacional la capacidad aprobatoria de los contratos petroleros que –como establece la Constitución– son de interés público, violando el artículo 150 e imponen el secreto en materias que son de interés de todo el país.
Finalmente se “legalizan” contratos, llamados de participación productiva, CPP, asignados de manera discrecional a operadores privados en detrimento de la propia PDVSA. Habría ahora que saber a favor de quién se entrega el petróleo de los venezolanos.
Es muy grave lo que sucede. Mas allá de las diferencias o disputas políticas, mas allá del odio y la intolerancia, del insulto y la descalificación, la defensa del petróleo y la soberanía debe ser un pensamiento y una aspiración nacional, de todos los venezolanos, de lo contrario, se estará hipotecado –así como si nada– el futuro de nuestro país.
