Which intern is getting fired for this AI slop pride flag creeping in here? Hehe. @MSJEGOI galti se mistake ho gaya kya?
On one hand your lawyers argue ki constitutional morality ke saare judgements per incuriam hai and doosri jagah ye?
This should get a community note 🙈
But that’s not how successful constitutional litigation works or has worked, anywhere. Historically, constitutional challenges have been successful when: (a) they are brought on behalf of coalitions of affected people, who coordinate their efforts and present a consistent stand.
Some people never learn. Horrible.
SC should stop petitions being named after the first person to file a case. Self-serving interests or ambush petitions? One really must wonder the motivation of filing these petitions instead of going to HC or bypassing community consultation.
#BREAKING Petition filed in #SupremeCourt challenging the constitutionality of the Transgender Persons (Protection of Rights) Amendment Act, 2026.
The amendment was passed by the Parliament recently, taking away the right to self-determination of gender.
The disappointment over the marriage (in)equality judgment is real, and goes beyond queer rights. If, like me, you're one of those idiots who likes to process disappointment by trying to understand what caused it, there's a lot in this judgment to unpack. Thread on what I found:
Chief Justice of India Dr DY Chandrachud was felicitated in-person with the ‘Award for Global Leadership’ conferred by the Center on the Legal Profession, Harvard Law School
CJI spoke about the initiatives at the Supreme Court that have been taken during his first year of tenure as the Chief Justice. These include incorporation of technology in court processes, launch of Handbook on combating gender stereotypes, etc.

@gautambhatia88 I've said this before but I'll say it again, the articulation in the submissions by you and the team were par excellence. The response to the judgement needs that clear an articulation. You, @utkarsh__saxena or someone from the team must write the rebuttal. Hoping against hope!🤞🏾
@nitinmeshram@Profdilipmandal The judgement holds to the contrary - there is unanamity & consensus in the judgement across opinions that A.15 discrimination includes sexual orientation and all social benefits that exclude LGBT relationships is exclusionary. Please read this 🧵: https://t.co/WN31Of9yhF
Having read the judgement now, 🧵 on what we have so far in the marriage equality judgement:
1. J. SKK holds Special Marriage Act violates Article 14 of the Constitution. But no suitable remedies available to court. Concurs with CJI though DYC does not expressly rule SMA unconst
@hamzamlakdawala@BhattRohin I don't think my analysis as has been done here: https://t.co/WN31Of9yhF needs a lawyer or professor's approval for me to have a fair view on it.

@hamzamlakdawala@BhattRohin So much for democratising the Constitution to the masses. :)
You may think there are reactionary comments (and some of that maybe true), what is also true is many of us have read the judgement and each of us can & should read it & come up with our own view on it.
This thread unrolled for better readability of the analysis on disagreements between the minority and majority opinions and the commentary on what the petitioners could now do with the judgement: https://t.co/RxGsp9yxO3

A.15 violations being treated this way is problematic. For eg. if there existed no SMA and there was no law to regulate inter faith marriages, would this court arrive at the same conclusions? Deference to an indifferent Parl. when there is Part III violation w/o remedies? ☠️
15. As discussed earlier these are the reasonings for the A.15 violations as penned down by Justice Bhat seem to be in concurrence with CJI. Therefore we have a clear unanimous opinion on A.15 discrimination on the basis of sexual orientation for social benefits.
