Jennifer Pan just won at the @SCC_eng. Amazing work by her appellate counsel @SDiGiuseppeLaw! At @BreanaVandebeek and I spoke to Jennifer and we are gearing up for the re-trial. There will be new evidence and a challenge to the very un-Canadian police commentary on @netflix.
Super excited that my partner in everything @BreanaVandebeek was just admitted to the SJD program @UofTLaw. Now, no one will ever believe that I write my own stuff!
We are looking for two new associates in our Atlantic Canada office. This is an opportunity to be involved with important and interesting criminal trial and appeal litigation. Salaries are negotiable. We intend to interview on a rolling basis. Applications to [email protected]
4/ In all three cases, France, Turpin, and Hosannah, the pathology evidence failed to fully account for knowledge found in the medical and scientific literature. https://t.co/k5ULsqd5A0
1/ This raises important questions about forensic pathology evidence in Canada. Personally, I have had three of these cases in recent years. How many others have gone undetected?
EXCLUSIVE: Late last month, I was in Brampton court to cover a pre-trial hearing in a high-profile child homicide case. I thought I wouldn't be able to report on what happened for months, because of the pub ban on jury trials. Then the case fell apart. https://t.co/b6lFtJoRPe
3/ On re-trial, the pathologists admitted having not reviewed important aspects of the relevant literature. They also acknowledged that Mr. Turpin’s statements, when evaluated in light of that literature, afforded a reasonable explanation. Charge stayed.

Had a great week running a murder prelim in Pembrook, Ontario, with my law partner @gorhamlaw, my superstar articling student @amyousseflaw and our furry firm members Gancho, Gucci, Frankie and Fendi. I’m lucky to have such a fun practice!
Yesterday a jury gave a deserving client a second chance by terminating his 25year parole ineligibility period after spending 17+ years in jail. My amazing principal @BreanaVandebeek put me on the file with her on my first day with the firm over two years ago. Best feeling ever!
WiCCD welcomes the newest member of our Executive Committee: @BreanaVandebeek - https://t.co/0jMihkPaWk Breana is an accomplished appellate litigator who will contribute significant strengths to our leadership. We are looking forward to working with Breana on all WiCCD ventures!!
There are a number of excellent candidates running for CLA director but I want to take a moment to endorse @BreanaVandebeek who doesn’t get nearly as much attention as she deserves. 1/4

Stopping street checks is a good start, but provincial and federal legislation provides plenty of alternatives for abusive stops and disproportionate policing. The police have to buy into the change for it to be effective. https://t.co/IK1Z0RhBqT
4/ Even so, the theoretical benefit of informants does not explain the lax oversight or legal rules that foster an environment where these corrupt relationships can thrive.
1/ This case, including the unreported evidence, exposes our broken informant system. An informant and an officer made a dirty deal: the informant would set people up and give info to police; in exchange, police would kick back money, drugs, and protection.
Former Toronto gang leader Jermaine Dunkley was acquitted on a Hamilton murder charge Thursday after a judge found “significant problems” with the evidence of the Crown’s key witness, whom he suggested had been improperly coached by investigators. https://t.co/hbAVaGJjSm
3/ Apologists for the status quo say the informant system is necessary for crime prevention. But there is no compelling evidence to support this claim. Most times, some extra police work would be effective, leaving no need to rely on corrupt informants.
