A family of 18 from Gaza has won the right to come to the UK after the Home Office refused their application and lost on appeal.

This wasn’t just a husband, wife and children. The case involved parents, siblings, their spouses and their children.

The Upper Tribunal ruled that refusing entry would breach their right to family life under Article 8 of the European Convention on Human Rights.

Of course people have compassion for innocent families caught up in war. Most people do. Whether it’s Ukraine, Gaza or anywhere else, nobody wants to see people suffer, but immigration policy cannot be based on compassion alone. Governments also have to consider housing, schools, the NHS, welfare, infrastructure and what the country can realistically support.

The concern some people have is that once one legal argument succeeds, lawyers will use it in future cases involving similar circumstances. If that happens repeatedly, the number of successful challenges could increase over time.

Human rights exist to protect people from abuse and injustice. The question is whether they are now being applied in ways that increasingly shape immigration policy through the courts rather than through Parliament.

Every successful legal challenge also comes with costs……court time, government lawyers, tribunal resources, legal aid etc….all ultimately funded by taxpayers.

The bigger question isn’t about one family.

It’s where the line should be drawn between protecting family life and maintaining a country’s ability to control its immigration system.
