Sworn witnesses like Fauci can invoke selectively (at great risk of waiving on substantive questions) but should not do so on questions that pose no reasonable risk of legal peril.

@damintoell You don’t understand the privilege. It can’t be invoked to avoid engaging in new criminal conduct (ie perjury). You can’t say “I refuse to answer on the grounds you’ll charge me with lying”. The legitimate jeopardy is from State charges.

@JustElliot2 Oh people certainly abuse the privilege and I know of no notable consequences for doing so. I think there’s a legitimate line of questioning when his public statements are at odds with his internal memos but the clips of Hawley certainly don’t meet that standard.

@JustElliot2 Future state charges for past conduct, yes. But if he's really using it to avoid charges of perjury arising from the testimony in question it would be in bad faith. And Hawley's questions were clownish, but Fauci cannot use the 5th to avoid questions with no legal implications.

But he can invoke the 5th if he could be charged under state law which exceeds the reach of a Presidential pardon.
