Our Constitution was designed with one clear principle. No single political office should have unchecked control over public money. That is why it separates political leadership from the management of the country’s finances.
Article 225(1) establishes the National Treasury as the constitutional custodian of public finances. Its role is too important to be left to politics alone.
Yet Section 11 of the Public Finance Management Act places the National Treasury under the National Executive and under the authority of a political Cabinet Secretary.
This is not a small legal issue. It goes to the heart of constitutional governance.
Parliament has the power to make laws that implement the Constitution. It does not have the power to change the Constitution through an ordinary Act of Parliament.
When the independence of public financial management is weakened, the checks that protect taxpayers’ money are weakened too.
The Constitution must remain above politics. Every law passed by Parliament must respect it.
If we fail to defend Chapter Twelve today, we risk eroding one of the most important safeguards for accountability and responsible use of public resources.
The Constitution belongs to all of us. Defending it is a duty we all share.
A woman dressed up as an elderly mzee has turned up to vote in Ol Kalou when she ain't even a voter or a resident of that Constituency!
This now explains why we're seeing photos of elderly women who have been streaming polling stations as early as 5am!
I was trying to unravel that puzzle until I saw this video. Most definitely most of those might not be voters in that constituency!
One day, I was in a boda boda stage and I heard them talking about the Public debts.
I listened then I interrupted and asked them a very simple question.
" Nyinyi kama bodaboda, si mko na SACCO?"
They said yes.
" Na kwa hii SACCO yenu, si mko na chairman, Deputy Chairman na Treasurer?"
They said yes and I went on.
" Now imagine your Chairman, his Deputy and the Treasurer waamue saa hii waende Equity Bank, wachukue loan na jina ya SACCO thirty million bila kuwauliza, alafu hiyo pesa iende kwa accounts zao watumie kwa matumizi yao ya kibinafsi, then one day Equity Bank comes to you SACCO members that you have a loan to pay. You never consented, you never saw the money, do you allow your contributions to be used in paying that loan?"
MAJAMAA waliruka bwana, " hiyo hatuwezi bwana. John ( SACCO chairman) mkijaribu hiyo tunawaua."
Thereafter, I told them that that is the situation we are in as a country.
A situation where we are being overtaxed to pay debts we never incurred.
