警察は、HYBEの上場を控えて投資家を欺き、2,000億ウォン近い不当利益を得た疑いを受けているHYBEのパン・シヒョク議長について、捜査を終え、事件終結の手続きを進めている。

ソウル警察庁のパク・ジョンボ庁長は24日午前、ソウル鍾路区内子洞のソウル警察庁舎で開かれた定例記者会見で、パン議長の捜査について、

「捜査は終了したと報告を受けている。現在、終結手続きを進めていると承知している」と述べた。

パン議長に対する拘束令状の再申請（3回目）の可否については、「近いうちにお知らせできると思う」と述べた。

パン議長は2019年、HYBEの投資家らに「上場計画はない」と偽り、特定の私募ファンドに持ち分を売却させた後、IPO（新規株式公開）を進めた疑いを受けている。

警察は、パン議長が私募ファンドと締結した非公開契約に基づき、上場後の売却益の30％を受け取り、2,000億ウォン近い不当利益を得たとみている。

これに先立ち警察は今年4月、パン議長に対する拘束令状を2度申請したが、検察はいずれも補完捜査が必要だとして却下した。

一審「ミン・ヒジン氏の発言によって原告が特定されたとは認められない」
「訴訟の泥沼」に陥ったHYBE…経営権紛争の控訴審は9月開始

HYBE傘下レーベルBELIFT LABの社員が、ミン・ヒジン前ADOR代表を相手に1億ウォン規模の損害賠償訴訟を起こしたものの、最近、一審で敗訴した。HYBEは2024年にミン前代表との経営権紛争が始まって以降、現在進行中の訴訟だけでも19件に達するなど、「訴訟リスク」から抜け出せずにいる。

24日、オンラインコミュニティと時事ジャーナルの取材を総合すると、ソウル西部地裁民事22単独は21日、ILLITのビジュアル・クリエイティブ・ディレクターであるホ氏がミン前代表らを相手に起こした損害賠償請求について、「原告の請求には理由がない」として原告敗訴の判決を下した。

この訴訟はホ氏が個人の資格で起こしたものだが、キム＆チャン法律事務所と法務法人世宗がそれぞれホ氏とミン前代表を代理したという点で、これまで進められてきた訴訟と同じ流れにある。

ホ氏は、ミン前代表とHYBEの経営権紛争が表面化した2024年4月の記者会見での「ILLITがNewJeansをコピーした」という趣旨の立場表明、その後行われた株主間契約解除確認訴訟における訴訟代理人（世宗）の口頭弁論、メディア諮問会社が記者らに送ったメールなどによって、回復不能な損害を受けたとして訴訟を提起した。

一審裁判所は、ミン前代表側がホ氏を特定していなかったと判断した。

ミン前代表は記者会見当時、整理されていない言葉で「盗作、コピー、流出」の主体として「HYBE、パン・シヒョク議長、BELIFT LAB」に言及したものの、ビジュアルディレクターであるホ氏については別途言及していなかったという。

また、ミン前代表とともに訴えられたシン氏（元ADOR副代表）については、ミン前代表による立場表明や世宗の口頭弁論、メディア諮問会社が送付したメールの主体とはなり得ないため、共同での損害賠償責任は認められないと判断した。

ホ氏はまた、ミン前代表の記者会見後、ADOR所属のガールズグループNewJeansのファンダムから人格攻撃を受けたという趣旨の主張もした。

しかし裁判所は、ホ氏がミン前代表の記者会見当日に自身のSNSへ投稿した中指を立てた画像や、NewJeansの「Bubble Gum」ミュージックビデオ公開直後に投稿した映画『海街diary』のポスター画像などが知られたことが、攻撃を受ける原因になった可能性があると指摘した。

◆HYBEの訴訟規模は800億ウォン台…「財務への影響は軽微」

BELIFT LAB・SOURCE MUSICの親会社であるHYBEは、ミン前代表に対する経営権奪取疑惑を提起して以降、数百億ウォン規模の訴訟を続けている。

HYBEが最近公示した2026年半期報告書によると、現在進行中の訴訟は計19件、訴訟価額の合計は810億ウォンに達する。このうち、HYBEが原告となっている訴訟が15件、被告となっている訴訟が4件だ。

HYBEは同報告書で、

「（訴訟が）当期財務諸表に与える影響は重要ではないものと推定する」
と明らかにした。

HYBEの年間売上高が2兆ウォン台であることを考えれば通常の範囲だという判断だが、訴訟価額そのものは2025年の営業利益499億ウォンを大きく上回っている。

現在までの訴訟結果も芳しくない。

今年5月、ソウル西部地裁は、HYBE・BELIFT LAB・ILLITメンバー5人がコンテンツ制作会社FASTVIEWを相手に起こした2億8,000万ウォンの損害賠償訴訟で、HYBE側の請求をすべて棄却した。

同月、別のレーベルであるSOURCE MUSICとLE SSERAFIMメンバー5人がFASTVIEWを相手に起こした4,000万ウォン台の損害賠償訴訟についても、一審で敗訴した。

本案訴訟にあたるミン前代表との株主間契約確認訴訟でも、一審裁判所はHYBEによる契約解除の主張を棄却し、ミン前代表側の主張を認め、255億ウォン相当のプットオプション代金を支払うよう命じた。

この訴訟の控訴審第1回弁論期日は、9月18日にソウル高等法院で開かれる。

1. A portion of HYBE's shareholders are demanding that the company's board apologize to the five members of NewJeans, bring Danielle back, and reinstate MHJ as Ador's artistic director for the musical direction of NewJeans.

2. The Korea Fair Trade Commission has opened a formal investigation into HYBE for alleged mistreatment of NewJeans.

3. MHJ won the lawsuit filed against her by Xerian Hue.

4. The Personal Information Commission responded to the request regarding the alleged leak of information about Hanni's immigration status in December 2024, stating that it is conducting an investment aimed at major entertainment agencies and is taking steps to provide appropriate action in all matters related to Ador.

5. The Korea Fair Trade Commission has opened an investigation against HYBE for violating the “Monopoly and Fair Trade Regulation Act” by terminating the contract and demanding sanctions against Danielle.

For all those who have had doubts about why we should boycott, several of these points provide sufficient reasons to do so. Raising our voices and making noise influences the decision-making of those who have the power to implement it. The massive number of petitions to investigate Hanni's case is the best example of this, putting social and media pressure on the matter.

Boycotting not only serves to punish financially, but also to exert social and media pressure, to let the world know that we will not allow the rights of human rights defenders to be violated.
