If one is genuinely concerned with democratic equality in the justice system, the problem is not whether lawyers say “My Lord” or whether petitions use the word “prayer,” but the structural barriers that make courts inaccessible to ordinary citizens.
India has over 4.5 crore pending cases, yet year after year, sanctioned judicial positions remain unfilled against a sanctioned strength of around 1,108 High Court judges, more than 300 posts are often vacant, and the subordinate judiciary, which bears the bulk of the caseload, suffers from a chronic shortfall of judges and basic infrastructure.
This shortage means that litigants wait years, sometimes decades, for cases to be heard, while costs mount and justice becomes the privilege of those who can afford to sustain litigation.
Legal aid, though constitutionally guaranteed, is underfunded and poorly implemented, leaving vulnerable groups stranded in the system without effective representation.
Add to this the lack of technology penetration in many lower courts, inaccessible language of judgments, and routine adjournments that drag proceedings endlessly.
All of this creates a system where the democratic promise of “equal justice for all” is more fiction than fact.
If you truly want to democratise Indian courts, the urgent agenda is filling vacancies, investing in court infrastructure, and making the system affordable and efficient, not sneering at the vocabulary of courtroom courtesy that, in reality, has no bearing on whether justice is delivered.
