⚖️ Did you know that the Supreme Court in Moi Teaching and Referral Hospital & 3 others v Gikenyl & 74 others [2026] KESC 50 (KLR) held that the jurisdiction of the Employment and Labour Relations Court (ELRC) is not limited to disputes between existing employers and employees? The Court clarified that the ELRC's jurisdiction extends to pre-employment disputes, including challenges relating to advertisements of vacancies, recruitment procedures, shortlisting, interviews and selection processes. According to the Court, Section 12 of the ELRC Act should not be interpreted restrictively because Parliament deliberately used the word "including", signifying that the list of disputes falling within the ELRC's jurisdiction is not exhaustive. The Court therefore rejected the long-held assumption that an employer-employee relationship is always a prerequisite before the ELRC can assume jurisdiction.
