FORGING A #STRONGERINDIA, ONE DIPLOMATIC WIN AT A TIME!
The following case delves into a complex legal and human rights situation within the United Arab Emirates (UAE). The situation encompasses a range of legal issues, including civil litigation, judicial decisions, retaliatory actions, extortion, arbitrary detention, and embezzlement, all of which underscore significant breaches of fundamental human rights and international legal standards.
Civil Litigation and Judicial Decision: This case revolves around a dispute in 1995 involving an investor and real estate developer-contractor of Indian origin operating in the UAE. The dispute centres on a lease-build project for a tower with an Emirati landlord. Initially, the Abu Dhabi Civil Court acknowledged the investor's claims and issued an interim order to protect his rights, signalling a legal victory in this property-related civil matter.
Retaliation and Abusive Tactics: Following the granting of the interim order in the civil lawsuit, the investor found himself subjected to severe retaliation and physical abuse. The landlord, who asserted ties to influential figures in the ruling regime, exploited these connections. Some corrupt police officers colluded with the landlord to advance their own interests at the investor's expense, placing the investor's life in jeopardy. The investor became a victim of racially motivated violence in his Abu Dhabi office, perpetrated by the Emirati landlord and a group of policemen.
During the attack, the Emirati landlord and a plainclothes policeman wielded a one-meter-long heavy iron rod and steel shackles. The investor endured racial abuse, severe physical beatings, and had his fingers brutally injured by the iron rod. He was also coerced into relinquishing the interim order issued by the federal court in his favour. The attackers ransacked his office, looting money and valuables from a locker, which included funds intended for paying around 300 employees and subcontractors. Subsequently, he sought assistance from the police.
A group of police officers, who responded to the investor's distress call, unjustifiably sided with the trespassers and turned against him. They threatened his life, subjected him to brutal physical assault, shackled him, forcibly removed him from his office, tortured him both in a police vehicle and within police torture chambers. Due to the severe abuse inflicted by the policemen, the investor's condition deteriorated to the point of requiring emergency medical attention, leading to his hospitalization. He was then arbitrarily detained in various detention centres, where he was denied food and water, subjected to inhumane conditions, and often placed in solitary confinement.
Criminal Case Verdict: It took six months for the investor to make his first court appearance. The Court of First Instance expressed astonishment that a victim who had sought police protection was arrested and detained. The investor managed to convince the judiciary that the implicated policemen were acting under the instructions of the ruling elite. Eyewitnesses were summoned to testify in court.
One Pakistani witness reported that a policeman had brandished a one-meter-long iron bar, threatening anyone who approached the accused's (the investor's) office while making derogatory statements about Indians, Pakistanis, and Bengalis. Several witnesses from diverse nationalities, undeterred by the potential repercussions from the state police and public prosecution, courageously provided testimony that supported the investor's claims.
The Court of First Instance promptly acted on the evidence presented, declaring the accused (the #UAEinvestor) innocent and ordering his immediate release. Furthermore, the Court issued an investigation order against the policemen and the local Emirati for trespassing on private property and assault. Although the investor prevailed in this criminal case, he remained incarcerated as the prosecution appealed the decision.
Appellate Court Decision: The appellate court in Abu Dhabi granted bail during the appeal process. Nevertheless, despite the bail and sureties, the investor was not released from custody. A panel of eminent jurists was deeply moved by the compelling evidence that unequivocally exposed the orchestrated actions of the police and the prosecution's dishonest dealings. Consequently, a speedy trial was scheduled.
During a subsequent hearing, a policeman submitted a notarized declaration in which he withdrew his earlier allegations and pleaded guilty. The Emirati landlord followed suit, admitting his guilt. As more policemen confessed their wrongdoing, the prosecution expressed its willingness to accept responsibility. The Supreme Court unanimously dismissed the prosecution's appeal and ordered the restoration of the investor's dignity, rights, and privileges. The prosecutor's conduct was also censured. Moreover, the Honourable Supreme Court advised the investor of his right to pursue legal action against the perpetrators for damages incurred due to baseless and malicious litigation.
Continued Retaliation: Despite these legal developments, the UAE executive branch persisted in violating human rights. The executive initiated a vengeful attack against the investor, even resorting to criminal fraud to manipulate judicial orders and evade accountability for their actions.
Deportation via Executive Order: In a shocking twist, the Indian-origin investor was allegedly deported from the UAE based on false and fabricated records, falsely implying that he had been convicted of a crime by the court of law. This deportation contradicted the concurrent judicial declarations of the Abu Dhabi Courts, causing further trauma to the investor. The use of false accusations in the deportation process is particularly troubling, as it signifies a disregard for principles of justice and the investor's rights, dignity, and business assets, including real estate investments in that country.
This case raises significant concerns about the #RuleOfLaw, #HumanRights, and potential manipulation of the #UAE's judicial system. It underscores the importance of transparent and fair legal processes and the need for international scrutiny to address human rights violations and abuses of power in the UAE. It is imperative for organizations and governments to closely monitor and advocate for justice and accountability in such cases to safeguard the rights and dignity of individuals within the UAE.
