More time wasting and BS from the #ALJ and the @TheDemocrats who for decades promised rescheduling, but now we’re against it. Because @realDonaldTrump is getting it done. Childish, immature, and ridiculous behavior from our “representatives” just legalize it and get it over with.

Today’s “witness” at the DEA/ALJ hearing is the National Drug & Alcohol Screening Association (NDASA), which is odd because safety-sensitive testing isn’t going away — DOT/FAA/rail/trucking mandates are federal and independent of scheduling.
NDASA’s real interest is elsewhere. Here’s their stake:
👉Schedule I status is what forces zero-tolerance testing regimes. A lot of employer drug policy — and the “any detectable THC = fail” standard — is built on marijuana’s Schedule I framing as a drug with no accepted medical use and high abuse potential. Reschedule it to III, and the legal/cultural argument for treating THC like heroin or cocaine on a panel gets weaker. Non-DOT employers (the much larger market) may loosen policies once cannabis is officially “medicine.”
👉Revenue is volume-driven. NDASA represents drug/alcohol testing labs and third-party administrators (TPAs). Their business is built on pre-employment and random panels at non-federally-mandated employers. If cannabis testing gets dropped from standard panels — which is already happening in many states — that’s a direct hit to test volume and revenue, since THC is the single most commonly detected substance in workplace testing.
👉Rescheduling doesn’t fix positive-test-without-impairment. THC can show positive weeks after use, long after impairment ends. As more states legalize and public tolerance grows, employers are already dropping THC from routine screens. NDASA’s testimony will lean on impairment/safety framing (DUID, workplace accidents) — but the underlying incentive is that a Schedule I classification gives employers cover to keep testing broadly, while rescheduling accelerates the trend of employers deciding it’s not worth screening for.
👉So it’s not that will testing be banned” but that Schedule III will accelerate the shrinking of their addressable market outside the safety-sensitive carve-out that isn’t going anywhere regardless.
