எனவே, இந்திய அரசியலமைப்பின் #Article32 உச்சநீதிமன்றம் மற்றும் #Article226 கீழ் உயர் நீதிமன்றங்களுக்கு அரசியலமைப்புச் சட்டப்பூர்வத்தன்மையை பரிசீலிக்கும் அதிகாரம் உள்ளது.

#Article174 grants the Governor the authority to summon the State Legislative Assembly.
#Article163 states that this authority must be exercised on the aid and advice of the Council of Ministers.
#Article361 provides constitutional protection to the Governor for official acts performed in office.
The proper place to prove majority is the Legislative Assembly itself.
Before such a process of proving majority can take place, the constitutional authority to summon the Legislative Assembly has been vested with the Governor.
Everyone must understand the constitutional distinction between these two stages.
Therefore, under #Article32 of the Constitution of India, the Supreme Court, and under #Article226, the High Courts, possess the power to examine constitutional validity.
However, the courts themselves cannot perform a function that has been directly entrusted to the Governor by the Constitution of India.
