βThe Dutch Immigration and Naturalization Service (IND) has formally ended last June 10, Tuesday, the process for the asylum plea of former Duterte spokesman Harry Roque after it asked German authorities to take over the case.
This information was given to me today by a reliable informant.
"His case was terminated last June 10 and the dossier was turned over to Germany. Germany has issued the Schengen visa to Roque and therefore the German immigration authorities has to handle his case under the principle of the Dublin Regulation," according to the informant.
The informant added that as far as The Netherlands is concerned their German counterparts have taken over Roque's case.
The Dublin Regulation is an agreement between EU member states, Iceland, Liechtenstein, Norway, and Switzerland that determines which country is responsible for considering an asylum application.
The general rule is that the country of first entry into these countries is responsible, unless the asylum seeker has been registered in another Dublin country.
It is not clear whether Roque has been physically escorted by the Dutch police to Germany last June 10 as normally required in deportation rules.
On his official Facebook account, Roque posted two photos in formal attire and added a cryptic caption "On a mission." It is not clear when and where the photo was taken although it was posted half an hour ago.
Roque has repeatedly claimed in the last few months that he cannot be arrested by Interpol/Europol so long as his asylum plea is unresolved. Philippine authorities have issued several statements that they are coordinating with their European counterparts to effect the arrest of Roque following the issuance of a court order where a human trafficking case is pending against Roque and several other respondents.
Technically, and with the formal decision from the Dutch IND, Germany assumes jurisdiction over Roque. It is also not known whether Roque has applied for asylum in Germany or if he is required to re-start his plea all over again.
Legal experts I checked with said that in this case the IND has not taken the option to assume responsibility.
"If Germanyβs responsibility was confirmed and Germany accepted the request, the Netherlands should have transferred him within the prescribed time limits
"Only if the Netherlands chose to exercise its discretionary power under Article 17 of Dublin III (e.g., for humanitarian or practical reasons), could it have taken the case into consideration itself," according to a Dutch legal expert.
A so-called "standard" appeal to Dutch authorities is not possible since the Dutch IND has now refused to assume jurisdiction and has not even formally initiated probing into Roque's asylum claims.β
