I am writing to bring to your attention what I believe is a significant governance gap in Arizona that I have identified through more than two years of research.
My professional background is in compliance, risk management, and corrective action planning. Throughout my career, when a significant compliance issue was identified, there was a defined governance process. The issue was evaluated, classified based on its significance, assigned to an accountable owner, investigated, corrective actions were implemented when warranted, the effectiveness of those corrective actions was verified, the issue was monitored, and it was formally closed.
Over the past two years, I have been trying to determine whether Arizona has a comparable governance process available to citizens who report potential violations of law, contracts, procurement requirements, policies, regulations, or internal controls.
I did not begin with the assumption that a governance gap existed. I reached that conclusion only after following every avenue I was directed to pursue.
I have reviewed statutes, procurement documents, administrative procedures, court records, and other publicly available materials. I have contacted multiple state and county offices seeking the same answer.
I discussed the issue with my state legislator, Senator JD Mesnard. He advised that unless new legislation was needed, the matter belonged at the county level.
I then attempted to work through Maricopa County. I sought assistance from my County Board of Supervisors representative and the County Manager’s Office. Ultimately, I was directed to Maricopa County’s existing reporting channels for contract compliance, procurement concerns, and unethical conduct.
On September 26, 2025, I submitted a criminal complaint to your office regarding the June 4, 2020 contract amendment signed by Kevin Tyne. That complaint followed my efforts to understand the amendment and obtain the related contract history. Although I was later informed by the Maricopa County Manager’s Office that the June 4, 2020 document was only an amendment, when I requested the underlying contract and complete amendment history, I was not provided those documents and was instead directed to submit a complaint. That became one of many steps I took to understand how Arizona evaluates and resolves significant compliance concerns.
I also contacted the Arizona State Ombudsman. I was informed that the county ombudsman is not an independent certified ombudsman with authority to resolve these types of county governance concerns and that their office could not assist me.
Finally, I pursued this issue through litigation. During those proceedings, the county produced the documents it identified as responsive. However, the governance questions at the center of my research remained unanswered because I was unable to identify documentation establishing who is responsible for ensuring that a citizen-reported compliance concern is independently evaluated, assigned to an accountable owner, investigated, corrected when warranted, verified, monitored, and formally closed.
At no point during my research, my complaint to your office, my work with Maricopa County, my discussions with the Arizona State Ombudsman, or the litigation was I provided documentation identifying who owns that end-to-end governance process.
After following every path I was directed to pursue, I keep coming back to the same unanswered question.
When a citizen reports a significant compliance concern, who is responsible for ensuring that the concern is independently evaluated, classified based on its compliance significance, assigned to an accountable owner, investigated, corrected when warranted, verified, monitored, and formally closed?
