It is absolutely crazy that someone can be arrested for calling a Chief Minister a "delivery person" on TV, especially two years after the remark was made. A State Secretary in the Telangana Congress Social Media Department filed the complaint. Police then registered an FIR invoking public-order and group-enmity provisions. The complaint also alleged defamation. But police did not register defamation, which is non-cognizable and, by itself, does not permit a warrantless arrest. Instead, they relied on cognizable public-order provisions to make the case arrestable. The remarks had already been public for two years. If they were really likely to cause riots, public disorder or hostility between communities, where is the evidence that any of this happened? The FIR identifies no actual riot, breach of peace or conflict between groups. The arrest also appears contrary to recent Supreme Court rulings. In Imran Pratapgadhi, the Court said police must examine the actual words used and cannot mechanically turn speech into a public-order offence. In Satender Kumar Antil, it held that for offences punishable with up to seven years, notice is the rule and arrest the exception. Police must record why arrest is genuinely necessary. Telangana Police should disclose whether any notice was served, what reasons were recorded and why arrest was considered necessary for a two-year-old television remark. This is political targeting through the misuse of criminal law and police power. Rude speech should be answered with criticism, not handcuffs.
