5/6The questioning exposed fundamental flaws: neither the court nor the defence knows the analysis criteria or AI algorithms employed by Chat-X. This lack of transparency and verifiability undermines data integrity and violates core principles of a fair trial (Art. 6 ECHR).
4/6 Law enforcement enjoys full access to the Chat-X interface and real-time results. For courts and defence? Only simplified Excel tables are provided, stripped of complete metadata, algorithm details, or raw data—rendering independent verification practically impossible.
3/6 Chat-X, developed by the Dutch police, automatically processes and analyses vast quantities of encrypted messages (trained inter alia on EncroChat data). AI scans for trigger words ,cross-references with location, IMEI, and SIM data, and scores risks of concrete threats such as planned murders or kidnappings.
2/6 The BKA witness stated: SkyECC data was received from France as a “Chat-X Export” including SHA-1 hash values. The portal Chat-X is known and has been used in SkyECC cases for data processing and conversion to Excel spreadsheets.
