NEW: Lindsay Clancy’s attorney, Kevin Reddington, has filed a renewed motion asking Judge William Sullivan to enter a finding of not guilty by reason of lack of criminal responsibility on all charges, rather than allow the case to proceed toward a potential second trial. Reddington says the motion does not rest on the jury’s reported 11-1 split. Under Massachusetts Rule 25, he argues that even when the trial evidence is viewed in the light most favorable to prosecutors, the Commonwealth did not present enough evidence for a rational juror to find beyond a reasonable doubt that Clancy was criminally responsible at the time of the killings. He emphasizes that all six forensic experts agreed Clancy was suffering from a serious mental illness, arguing the prosecution’s evidence of planning and her ability to perform routine tasks did not prove she could appreciate the wrongfulness of her actions or conform her conduct to the law. Reddington does note that 11 jurors were reportedly prepared to find Clancy not criminally responsible, while the foreperson said the lone holdout had “acknowledged doubt but was refusing to apply it to the case as the law states.” If Sullivan grants the Rule 25 motion based on insufficient evidence, the defense argues it would amount to an acquittal and bar a retrial. Reddington is asking for the motion to be heard Sept. 29.
