Let's break down the procurement red flags in #SriLanka's hugely problematic coal tender based entirely on the FACTs:
1) The Coal Company (LCC) approved its Master Procurement Plan and notified the Ministry to appoint a committee to manage the coal tender on APRIL 10.
Once again, over-staffed, monopolistic @CEB_lk in a mega scandal. "A loss of Rs. 7.67 billion of public money means there is either a scam at worst, or incompetence at best. Either way, it does not look good for the administration."

What is going on with this coal issue? Is it a scam?
Here is what I understand so far ππ»
The Ceylon Electricity Board has officially estimated Rs. 7.67 billion in direct losses from 8 recent coal shipments.
That figure is calculated on a worst-case basis using replacement power at Rs. 57.53 per kWh. It does not include penalties that may be recovered from the supplier.
Now to the quality issue...
Investigative reporting in the Sunday Times by @nimilamalee cites Lakvijaya plant data showing multiple shipments allegedly failing key parameters.
Reported figures show GCV readings as low as 4,805 against reject values near 5,900, and ash content above 22% against a stated reject threshold of 16%.
The supplier chain runs via Indiaβs Trident Chemphar, sourcing coal from South Africa.
Here is where it becomes complex for me...
Discharge-port testing reportedly indicates compliance with contract specifications, but plant-side operational data suggests otherwise.
The contract provides for a third-umpire mechanism to resolve such disputes. That mechanism has not been triggered. Why?
So the situation is this...
CEB is calculating Rs. 7.67 billion in losses.
Plant data suggests substandard coal.
Port testing suggests compliance.
Penalties are not reflected in the loss calculation.
The dispute resolution mechanism has not been used.
From all this, what I can infer is that this is now a procurement, enforcement and accountability issue.
Here is what I would like to see...
β The full tender documents and any amendments
β Shipment-by-shipment test results, plant and port
β The penalty calculations and recovery status
β A clear explanation of why the contractual dispute mechanism has not been activated

In a shocking turn of events, President Anura Kumara Dissanayake has been pushed into an uncomfortable spot with the Commission to Investigate Allegations of Bribery Or Corruption (CIABOC) preparing to file action against Energy Minister Kumara Jayakody over allegations of misappropriation of funds during his tenure at the Fertliser Corporation in 2015.
To make matters worse, a group of opposition politicians and civil society activists are also preparing to file a contempt of court case against Jayakody for a remark he made against a judge in a recent interview he did with a private television channel. If found guilty in either case, Jayakody could face serious charges.
Minister Jayakody is a man very close to President Dissanayake and he is considered one of the President's closest friends for many years. In fact, he was introduced to the Fertiliser Corporation by Anura Kumara Dissanayake when Dissanayake was the Minister of Agriculture in the UPFA government under Chandrika Bandaranaike Kumaratunga.
Since then Jayakody and Dissanayake have shared a strong bond and Jayakody played a strong role in Dissanayake's campaign prior to the Presidential https://t.co/ivQRhxGZA6, with allegations surfacing that he may have misappropriated funds worth Rs. 8 million while heading the Fertiliser Corporation in 2015, President Dissanayake has been informed by some of his close confidantes that it will be better if Jayakody steps down.
To immediately save face, the Daily Mirror learns while Jayakody has not been asked to step down as of now by the President, Dissanayake will await the update of the court's verdict.
However in his weekly meetings with senior NPP Cabinet ministers, President Dissanayake has already been advised it will be better if Jayakody willingly steps down while the investigation is ongoing.
Several attempts to contact Jayakody yesterday for a comment failed but a source close to him said that there were no plans for the Minister to tender his resignation.
The opposition themselves will not spare this matter when Parliament convenes this week. The Daily Mirror learns that ITAK MP Shanakiyan Rasamanickam will call for the resignation of Jayakody or else question the government how a minister who is facing corruption allegations can continue to hold a portfolio.
Rasamanickam had six months ago already mentioned in Parliament that an individual who had been interdicted over a financial fraud in the Fertilizer Corporation was now a member of the NPP cabinet.
