For years in the vape Industry we listened to Regulatory promise predators that preyed on mostly the Eliquid manufactures. I saw them waste millions on the vague promises of PMTA compliance and cooperation of FDA only to have FDA gate keep Big Tobacco and put even more regulations and now enforcement actions to shut down thousands of businesses across the US. Those predators knew the game was rigged as most of them came from the Big Tobacco Regulatory industry and saw opportunities to sell an idea more than a promise to fulfill PMTA approval. Ok... So thousands of companies wasted their time and money. Now we are promised that new new PMTA changes are really coming.... But are they really? Nobody @ FDA is even talking about flavored Eliquids or the various Ends Hardware. We need separate pathways and that needs to be in the discussion but it's not. BTW does anyone actually think Juul 2 or other Bluetooth ID/Age gated devices will actually sell? HINT: it will be a colossal fail financially but more importantly a fail for public health. You know APPH as they will get low single digit adoption and end up pushing adults back to smoking or the black market. There are better paths forward BUT..... my DC sources who now have a 100% track record are already telling me nothing will change and that this is all smoke and mirrors and that only Big Tobacco will come out ahead because that's how the system is rigged. But is that good APPH? No it's not. Vaping is a technology at the end of the day China has schooled both FDA and Big Tobacco on how it should be done and made better widgets. We could do better, but we won't because there are career people at FDA that are both protecting their jobs as well as their future jobs as most we'll head off to work for big tobacco or big Pharma. APPH is a purple cow and Regulatory capture is the name of the game.
