Happy #FairUseFriday, y'all! Today we're celebrating the impact of fair use in documentary film, and especially the impact of the Statement of Best Practices in Fair Use for Documentary Film. As we explain, filmmakers' embrace of fair use opened creative floodgates.
#FairUseFriday 🎥Documentary filmmakers rely on fair use to include archival footage, images, and sound as part of bold, new stories that add to our collective understanding of the world! Doc filmmakers used to fear that telling certain stories would be too risky or expensive because of copyright. They avoided projects that focused on topics they thought would require expensive permissions for clips used in critique or commentary, or projects where a copyright holder could withhold permission as a way of censoring the film.
That all changed in 2005, when a coalition of documentary filmmakers developed the Documentary Filmmakers' Statement of Best Practices in Fair Use, a set of guidelines that laid out the situations where filmmakers most often encounter copyright concerns and where the community was confident they could rely on fair use.
The result was dramatic: within a year of the statement’s publication, filmmakers were able to get all-important Errors & Omissions insurance policies that covered their fair use claims, making it possible to make and sell films that relied on fair use. In the years that followed, countless films have been made that simply could not have existed without fair use.
