THE INTERNATIONAL LAW FRAMEWORK SUPPORTING #HARTI SOVEREIGNTY Core Legal Instruments: 1. Vienna Convention on the Law of Treaties (1969) - Article 52 A treaty is void if procured by threat or use of force. Both the Warsangali coercion (exile of Sultan Mohamoud Ali Shire) and Dhulbahante incorporation (1920 RAF bombing) violate this. 2. Vienna Convention on Succession of States (1978) A successor state cannot inherit invalid territorial claims from a predecessor state. #Somaliland cannot inherit territories Britain never validly acquired. 3. Montevideo Convention on the Rights and Duties of States (1933) The Harti confederation possessed all four criteria for statehood before colonization: permanent population, defined territory, functioning government, and capacity for international relations. 4. ICJ Western Sahara Advisory Opinion (1975) Territories inhabited by peoples with social and political organization cannot be treated as terra nullius or divisible by geometric boundaries drawn by distant powers. 5. UN Charter Article 2(4) and Customary International Law Territorial acquisition through force is prohibited. Colonial conquest cannot create valid successor state claims. The Sovereign Truth: 1.The Warsangali treaty never bound future generations (no “heirs and successors” language) and lapsed in 1960 - so when did Warsangali territory become part of Somaliland?
