OK, this is both unintentionally hilarious and pretty serious at the same time, so please listen up.
Some dude named Noah Veon, a recent college grad who lived with his mom in 2021, and quite literally sold hot dogs out of a Lowe’s parking lot in South Carolina under the name “the Grumpy Weiner,” sued Richard Heart after apparently losing a few hundred dollars in HEX. His attorneys filed a John Doe lawsuit hoping to keep his name hidden for as long as possible, probably for the obvious reasons above.
The Complaint was filed in 2022 in the Court of Common Pleas (who tf knows what they do there) in Florence Co, South Carolina (yeah, I don’t know where that is either), and seeks 3 things, one of which is the reason I’m writing this.
They’re seeking to certify the case as a class action and want the court to issue a declaratory judgment that HEX is a security. Then, the other 2 claims (violations of SEC Rule 5 and some South Carolina securities law I’ve never heard of) would be on the table.
Richard has not appeared in the case. Default has been entered against him after the court somehow authorized service by TG message, Tweet, email, and some other dumb stuff. Since I have never talked to Richard, I have no idea why he didn’t respond, but I can guess that if you had to pick one of two cases to appear and defend, it would be the one filed by the SEC and not some hot dog vendor in a Lowe’s parking lot. It is conceivable that appearing there also might create issues with RH’s personal jurisdiction argument in NY, but you'd have to ask his legal team about that.
Still, there is a real danger to having that court issue a declaratory judgment that HEX is a security. Because you’ve all been to #PulseChainLawSchool, you know that nothing this SC judge is binding in RH’s NY case, but we know that the SEC has conveniently left out important facts in recent cases (like the fact that a court issued an order without telling the judge that the other party never appeared to contest the case). So do we trust the SEC to be honest this time around? Hell-f*ing-No.
There is a hearing approaching fast as to whether to certify the case as a class action. Since there is no opposition to that motion, it very well may be granted. The danger is that the court also considers the issue of whether HEX is a security, which again, at this point is uncontested by anyone.
So @MatiAllin has been putting in work talking to lawyers in SC (a job you really don’t want, believe me) and found one willing to draft an amicus brief on short notice on behalf of Hexicans who don’t think this class action is in their best interests. It’s sure as shit not in my best interests for some douche-wagon attorneys in SC to get a judgment for millions of dollars against RH or for HEX to be declared a security.
Mati is going live here very soon to discuss this further, but the short-short version is that he is going to be posting a donation address and is asking ONLY WHALES to contribute to the drafting and filing of an amicus, which is apparently going to run around $100-200k. That seems like a lot for a brief, but as we all know, securities lawyers aren’t cheap, and asking any lawyer to do shit on an expedited basis just means you’re asking them to put the rest of their clients on hold and get your shit done asap, and that costs extra.
I spent a decent part of this past weekend reading every filing in that case, and I tend to agree with Mati that there needs to be something filed that gives the judge something else to evaluate other than the Plaintiff’s one-sided rendering of facts and events. Since Richard hasn’t, can’t, or won’t for whatever reason, Mati’s idea is probably the next best one.
I wanted to get this up before Mati goes live tonight. But I’m sure he’ll have a lot more to say. I, however, have to watch Florida kick the shit out of Edmonton and take home the Stanley Cup.

Haters. I have extremely bad news for you. HEX is never going away. Ever. It launched completely decentralized 1,434 days ago. It can't be shut off, by anyone, ever. Sorry for your loss haters. But wait, there's more. HEX's price on #Ethereum is still up 14,853% since Jan 5, 2020. You think I'm done? I'm not. If you staked, for a single day, called Big Pay Day, you got at least 33% more coins. But it could have been 50%, it's happened so many years ago I can't even remember now.
Oh but wait, there's more! When PulseChain launched, everyone got a free valueless copies of all their coins on Ethereum. The free valueless HEX copy you got on PulseChain is now worth more than the HEX on ETH. How much more? Nearly double. And all your stakes got copied over as well, if you had any!
What does that mean? Well, many years ago, there was no HEX, and now many years later, there's lots of HEX and it's worth lots of money. But wait, there's more. You could have minted HEX for free if you were a bitcoin holder. Surely you minted your free HEX. Man it really would suck for you if you didn't mint for free a coin that went up 1,000,000% in price, not even including staking, or big pay day, or the free PulseChain; world's largest free airdrop copy.
But you see, the same idiots that couldn't do math then, still can't do math now. They don't know what it means to create the world's first Proof of Wait cryptocurrency. They don't know what it means to create something literally more secure than Bitcoin. They don't know what it means to create something that's truly decentralized, censorship resistant, robust, and yet magically, was still free to mint!
A bunch of losers, with who didn't raise $27M for charity, give away free self help books and videos, or call the Bitcoin top on the day, or warn everyone to stay away from Celsius, Gemini Earn, FTX, BlockFi, margin trading... They think they are better than Richard Heart. Why? No idea. The measurable evidence shows he's great, and you're trash. Get on his level?
Where are your free coins? Where are your free books? Where are your free videos? Where is your $27 raised for charity? Where is your Bitcoin top call? Where is your Layer 1 network?
TLDR; Richard Heart's inventions make men that think they're smart very angry. The chip on their shoulder somehow blinds them from seeing the overwhelming evidence that Richard is greater than they will ever be. Even now, when crypto is under attack, Richard is doing the most important thing possible, educating you on how to protect your rights and win back some you lost. What are they doing?

From an outsiders view that is understandable. But if you want your information straight, Richard always planned to only do it for 2022. 2023 its back to normal.
