2/2 —the Holding Foreign Companies Accountable Act— which was passed by Congress to get lawproof Chinese firms off US stock exchanges. So it’s fine to say “delist” but we’ve seen since #HFCAA that it doesn’t do all that much, esp when the Chinese firms are backed with VC/PE $.

The CCP’s #goldenshares in #Bytedance are critical to why there can be no JV w/ them or any other Chinese tech firm that would meet the legal standard for divestment. While delisting these firms is all well & good, most have already *voluntarily* delisted after the #HFCAA 1/2

After having met with many people regarding the TikTok issue, it is apparent that what’s known as a “Chinese golden share structure” is standing in the way of saving TikTok. If a company has a “golden share structure ” it means that one of the shareholders is Xi Jinping, the head of the Chinese Communist Party. He owns you and makes all the decisions. While I want TikTok to keep operating in a manner consistent with our national security, it is long past time to deal with the golden share dilemma more broadly. I will soon introduce legislation with my Senate colleagues that prevents any company that has a “Chinese golden share” from being listed on any American exchange and further, remove any existing company that has a golden share structure from any American exchange.

One of the firms fined is a mainland Chinese auditor. We are still waiting for outcome of the 2nd HK auditor review trip earlier this year. #HFCAA

So, according to #PCAOB Chair Williams, it was a “tough agreement” but they were able to get EVERYTHING they needed to conduct the latest review. Investors are better protected because of this and now the companies need to act to comply with their deficiencies. #HFCAA

There are currently 266 listed US companies that have lost at least 90% of their market cap from their 52wk highs. Their ave mcap now is $83m. That means investors lost at least $200bn just from these bottom performers. Educate, don't overregulate. #PCAOB #HFCAA

This is something that should have been done a looooooong time ago. Timing is funny. Perhaps trying to deflect from the total lack of oversight (and complicity) on what was going on with #FTX while spending resources to put pressure on other companies to adhere to #HFCAA. 🤔
