Former #AIADMK MLA #IsakkiSubbiah (#TVKVijay) had sought permission to continue as an MLA until the case concerning his resignation was resolved, citing the restrictions on holding a by-election and the difficulties faced by his constituency in the absence of an MLA. However, the High Court has now refused to entertain his plea seeking permission to continue as an MLA. Under Article 190(3)(b) of the Constitution, an MLA's seat becomes vacant once the resignation is accepted by the Speaker. Assembly Speaker JCD Prabhakar has told the High Court that he was satisfied that the resignation was voluntary and genuine.
Meanwhile, the case filed by the AIADMK challenging the circumstances surrounding his resignation and seeking action on its pending disqualification petition against him remains before the court. This leaves Isakki Subbiah in a difficult legal position. The High Court has refused to grant him the relief of continuing as an MLA, while the AIADMK's case concerning his resignation and disqualification is still pending. If the court ultimately interferes with the Speaker's acceptance of his resignation, his MLA status could potentially be restored. However, that could also bring the AIADMK's pending disqualification petition back into focus. If the Speaker subsequently disqualifies him under the anti defection law, he could lose his Assembly membership anyway.
Even if he is disqualified as an MLA under the anti defection law, he cannot be barred from contesting a fresh election merely on the ground of that disqualification. The Tenth Schedule does not prescribe any separate period of disqualification from contesting elections, and the Speaker cannot create such a bar on his own. The grounds for disqualification from contesting elections under the Representation of the People Act do not include disqualification under the anti defection law.
However, a member disqualified under the Tenth Schedule cannot be appointed as a Minister during the period specified under Article 164(1B) of the Constitution. That said, the disqualification does not permanently bar him from becoming a Minister. While it prevents him from immediately holding ministerial office after being disqualified for defection, winning a fresh election can lift that bar.

The Madras High Court, on Tuesday, has refused to entertain an additional petition filed by former #AIADMK MLA Dr Isakki Subbiah, seeking to withdraw his resignation and continue as the MLA representing the #Ambasamudram Assembly constituency.
The development came during the hearing of a petition filed by AIADMK whip Agri S. S. Krishnamurthy challenging the decision of Tamil Nadu Assembly Speaker J. C. D. Prabhakar to accept the resignations of six AIADMK MLAs.
The six MLAs are S. Jayakumar, Maragatham Kumaravel, P. Sathyabama, Dr. Isakki Subbiah, C. Vijaya Bhaskar and M. R. Vijayabhaskar. They had won the 2026 Assembly election as AIADMK candidates and subsequently resigned and joined the Tamilaga Vettri Kazhagam (TVK).
The case is being heard by a Division Bench comprising Chief Justice S. A. Dharmadhikari and Justice G. Arul Murugan. The Speaker has told the court that he accepted the resignations only after conducting an inquiry and satisfying himself that they were voluntary.
During the latest hearing, counsel for Isakki Subbiah informed the Bench that he had submitted a letter to Speaker J. C. D. Prabhakar on August 28, seeking to withdraw his resignation.
He also sought permission to continue functioning as the Ambasamudram MLA until the final decision in the case relating to the proposed by-election. His side argued that the constituency's residents were being affected because there was no sitting MLA.
Counsel informed the court that an additional petition would be filed seeking appropriate relief.
However, the Chief Justice-led Bench categorically refused to entertain the additional petition seeking withdrawal of the resignation and permission to continue as MLA.
The Bench also reserved its judgment, without specifying a date, on the main petition challenging Speaker J. C. D. Prabhakar's decision to accept the resignations of the six AIADMK MLAs.
