Lets understand the biggest of all: TITLE TRANSFER OF THE LAND i.e. RERA Section 17, regarding the title of the common areas including the entire land of the project;
The said section of RERA has been deliberated in the highest court of the country and the issue is legally settled now.
Supreme Court in Bikram Chatterji & Ors. v. Union of India & Ors. (2019 SCC On Line SC 901):
Paragraph 116: "It is apparent that after the transfer of conveyance deed, the title vests in the allottee and of the common area in the association of the allottees or the competent authority as the case may be. No title remains with the promoter."
Paragraph 121: "It is clear that common areas as provided under Section 17 have to be ultimately handed over to the Association of Allottees or the Competent Authority as the case may be. Thus, any sub-lease, alienation or transfer affected by the promoter of the common areas as defined in the RERA and otherwise reserved under the plan shall be void and inoperative."
CAN #KARNATAKA CHALLENGE THE CENTRAL ACT?
Lets understand few more provisions which need a serious relook.

2⃣Section 64: Overriding-effect clause quietly downgraded
3⃣Deemed-vesting remedy for pre-Act legacy projects
4⃣Persistent SBUA-vs-carpet-area conflict
5⃣"Private area" definition layered on top of RERA's carpet area, without reconciling the two
6⃣Clashing voting-rights definitions: Section 2(u) vs Section 21(7)
THEN WHY❓A few theories in the quest to find out the answer ⬇️
Theory 1: "Let courts sort it out": bury the contradictions, let litigation drag on for years while buyers wait.
Theory 2: "Homebuyers won't notice": banking on the assumption that flat owners are too busy/novice to read a Bill No. 14 of 2026 line by line.
Theory 3: Builder lobby had more seats at the drafting table than homebuyer associations/federations did. Funny how the clauses favor the party with deeper pockets.
Theory 5: Leave it vague on purpose: pass it, then quietly amend via rules/notifications later, away from public scrutiny.
Theory 6: A federal turf war: testing how far Karnataka can carve its own apartment law before RERA/Centre pushes back. (West Bengal tried this through HIRA and failed)
Theory 7: All are involved in Real Estate business. Even the opposition will keep quite.
The effect is documented, the motive: you decide.

KAOMA ಸುಗ್ರೀವಾಜ್ಞೆಯತ್ತ ಸಾಗುವುದು ಸ್ವಾಗತಾರ್ಹ ಹೆಜ್ಜೆಯಾಗಿದೆ, ಆದರೆ ಅದು ಈಗ ಸಕಾಲಿಕ ಕ್ರಮವಾಗಿ ರೂಪಾಂತರಗೊಳ್ಳಬೇಕು.

KAOMA ಜೊತೆಗೆ ಅದರ ನಿಯಮಗಳು ಮತ್ತು ಮಾದರಿ ಉಪ-ಕಾನೂನುಗಳನ್ನು ಸಾರ್ವಜನಿಕ ಹಿತಾಸಕ್ತಿಯಲ್ಲಿ ಪರಿಣಾಮಕಾರಿಯಾಗಿ ಜಾರಿಗೆ ತರುವುದನ್ನು ಖಚಿತಪಡಿಸಿಕೊಳ್ಳಲು ಬೆಂಗಳೂರು ಅಪಾರ್ಟ್ಮೆಂಟ್ ಫೆಡರೇಶನ್ (BAF) ಸರ್ಕಾರದೊಂದಿಗೆ ರಚನಾತ್ಮಕವಾಗಿ ಕೆಲಸ ಮಾಡಲು ಬದ್ಧವಾಗಿದೆ.
ಕಾಯ್ದೆಯ ಅಗತ್ಯವನ್ನು ಪ್ರಸ್ತಾಪಿಸಿದ ಎಲ್ಲಾ ಪ್ರತಿನಿಧಿಗಳಿಗೆ ನಾವು ಧನ್ಯವಾದಗಳನ್ನು ಅರ್ಪಿಸುತ್ತೇವೆ.

We welcome the Hon’ble Dy CM’s commitment to #KAOMA. However, the delay in tabling the Bill is a matter of concern for apartment residents in Karnataka.
Consultations with MLAs must translate into time-bound action. Apartment communities need clarity, not uncertainty—without an updated legal framework, governance and dispute resolution challenges persist.
The Bengaluru Apartments Federation (BAF) remains committed to working constructively with the government to ensure KAOMA, along with its Rules and Model Bye-laws, is implemented effectively in the larger public interest.
