Article I, Section 4 states that the “Times, Places and Manner” of congressional elections “shall be prescribed in each State by the Legislature thereof,” subject only to Congress’s power to “make or alter such Regulations” by law. In *Arizona v. Inter Tribal Council of Arizona* (2013), the Court confirmed that Congress can preempt state procedural rules via the Elections Clause, but only when it has actually legislated the conflicting rule (there, the National Voter Registration Act’s “accept and use” mandate for the federal form). 18 U.S.C. § 611 is a criminal statute that makes it a misdemeanor for a noncitizen to vote in a federal election. It regulates individual conduct. It does not contain any provision directing states to segregate ballots, halt processing, or adopt a specific verification procedure mid-election. Courts cannot rewrite the statute to add such a requirement.
In the current California case, the Department of Justice is asking a district court to order exactly that kind of mid-election procedural change. Multiple judges, including Trump-appointed Judge Mark Bennett on the 9th Circuit, have stated that such an order would conflict with the Elections Clause’s allocation of primary authority to the states. The 9th Circuit majority dismissed the emergency appeal without reaching the merits; Judge Bennett’s concurrence explicitly indicated he would have rejected the request on Elections Clause grounds. The district-court hearing before Judge Carter is the next step; no final merits ruling has been issued yet.
States already prohibit noncitizen voting in federal elections through their own qualification rules (which apply to congressional elections under Article I, Section 2). Section 611 adds a federal criminal penalty against individuals. Neither the statute nor the Elections Clause authorizes a court to order a state to alter its ongoing ballot-processing procedures in the manner the DOJ has requested. That is the governing law as written and as interpreted by the Supreme Court.
