In a Partition Suit, the important provisions and rules relating to witnesses under the Code of Civil Procedure, 1908 (CPC) are as follows: CPC – Order XVI (Summoning and Attendance of Witnesses) Order XVI Rule 1 – Filing of the List of Witnesses. Order XVI Rule 1A – Parties may produce their witnesses directly without obtaining a court summons. Order XVI Rule 2 – Application for issuance of summons to witnesses. Order XVI Rule 21 – A party to the suit may itself be examined as a witness. CPC – Order XVIII (Hearing of the Suit and Examination of Witnesses) Order XVIII Rule 4 – Examination-in-Chief may be filed in the form of an Affidavit. Order XVIII Rule 5 – Procedure for recording the evidence of witnesses. Order XVIII Rule 17 – The Court has the power to recall and re-examine a witness who has already been examined. Indian Evidence Law / Bharatiya Sakshya Adhiniyam, 2023 Section 104 – No particular number of witnesses is required to prove a fact. Importantly There is no provision in the CPC stating that witnesses are mandatory for filing a Partition Suit. However, during the trial stage of the suit, witnesses may be produced under Order XVI and Order XVIII of the CPC to establish title, share, possession, prior partition, and other relevant facts. Attesting witnesses are required in a Partition Suit only when the document relied upon by a party (for example, a Partition Deed, Will, or Family Arrangement) is a document that is legally required to be attested. Otherwise, attesting witnesses are not mandatory either for instituting the suit or for conducting the trial.
