(USA), sells computer accessories and peripherals under the trademark #PLUGABLE (US registration, first use September 2009), a deliberate misspelling of the dictionary word "pluggable." The Respondent, Richard Harrison (UK), registered the disputed domain name in February 2009, before the Complainant acquired any trademark rights and operated a consulting company named Pluggable Ltd. from 2007 until 2012.
In 2025, the Complainant's own founder publicly acknowledged on Reddit that "https://t.co/BSPcXUyXCy wasn't available, and can't be trademarked," which is why the Complainant chose the modified spelling PLUGABLE instead. Notwithstanding this, the Complainant filed a UDRP complaint arguing that the Respondent's 2026 reactivation of the domain for email use and its offer to sell at a mid-six-figure price should be treated as a new registration date for bad faith purposes.
The three-member Panel unanimously rejected that argument, holding that neither a period of non-use nor a later change in use can retrospectively convert an originally good-faith registration into a bad-faith registration, and that the Policy contains no provision supporting any "reset" of the registration date.
