L’#État gambien, comme tout gouvernement dans le monde, a l’obligation de faire respecter la loi et de maintenir l’ordre public. La #PublicOrderAct est conçue pour prévenir les troubles, protéger les institutions publiques comme #PURA (financée par les contribuables), et éviter les escalades violentes, comme celles observées lors de manifestations non autorisées passées (ex. : émeutes de #Serekunda en 2019, où des biens ont été #vandalisés). La #Police, en dispersant la manifestation et en procédant aux arrestations, a agi dans le strict cadre de la loi, conformément à la Section 18(4) du #CriminalCode, qui autorise l’usage raisonnable de la force pour « supprimer un #trouble, une #insurrection ou une #mutinerie ». Cette intervention était proportionnelle à la situation : aucun décès n’a été signalé, et les arrestations ont suivi un processus judiciaire transparent, avec comparution rapide et possibilité de caution.
Partout dans le monde, des lois similaires existent pour encadrer les manifestations. Par exemple, en #France, la loi du 10 octobre 1881 exige une déclaration préalable pour tout rassemblement public, sous peine de sanctions. Aux #ÉtatsUnis, des permis sont requis pour les manifestations sous le #FirstAmendment, avec des restrictions pour des raisons de sécurité publique. La Gambie, en appliquant la Public Order Act, agit comme tout État soucieux de l’ordre et du respect des textes légaux. Permettre des manifestations non autorisées risquerait de créer un précédent dangereux, ouvrant la voie à l’#anarchie et compromettant la #sécurité des citoyens et des institutions.

Keir Starmer says he doesn't support repealing the Public Order Act, which allows for arrests of peaceful protesters as he wants the legislation to "bed in".
"Just because there's a power for police to do something, doesn't mean they have to do it in every circumstance" he says.
