Should Canadian consumers be given the right to circumvent a technological protection measure in order to diagnose, maintain or repair certain types of products they own? A bill is currently before the Senate that seeks to achieve that very objective.
I had the pleasure of meeting with the Automotive Industries Association of Canada which supports the swift passage of Bill C-244. As they suggest, modern, web-connected vehicles collect thousands of data points on the health of vehicle systems. Without access to this data, independent auto repair shops cannot service a vehicle which, in turn, leaves customers without the right to repair their vehicle at the shop of their choice. Similar restrictions can apply to other consumer goods like appliances or technological devices. As my colleague Senator Deacon said during our debate on the bill last week, Bill C-244 is a crucial starting point in the drive to securing consumer access to competitive and affordable repair services and an aftermarket.

Les consommateurs canadiens devraient-ils avoir le droit de contourner une mesure de protection technologique afin de diagnostiquer, d'entretenir ou de réparer certains types de produits qu'ils possèdent? Le Sénat est actuellement saisi d'un projet de loi visant à atteindre cet objectif.
J'ai eu le plaisir de rencontrer l'Association des industries de l'automobile du Canada, qui soutient l'adoption rapide du projet de loi C-244. Comme ils le suggèrent, les véhicules modernes, connectés à Internet, collectent des milliers de points de données sur l'état des systèmes du véhicule. Sans accès à ces données, les ateliers de réparation automobile indépendants ne peuvent pas entretenir un véhicule, ce qui prive les clients du droit de faire réparer leur véhicule dans l'atelier de leur choix. Des restrictions similaires peuvent s'appliquer à d'autres biens de consommation tels que les appareils électroménagers ou les dispositifs technologiques. Comme l'a dit mon collègue, le sénateur Deacon, lors du débat sur le projet de loi la semaine dernière, le projet de loi C-244 est un point de départ essentiel pour garantir l'accès des consommateurs à des services de réparation compétitifs et abordables et à un marché secondaire.

I’m the Senate sponsor of C-244 — An Act to amend the Copyright Act (diagnosis, maintenance and repair). It addresses an invisible and very expensive problem that reaches directly into each of our lives, and wallets. Large manufacturers use their dominant positions in the market to make it unreasonably expensive, even illegal, for consumers (or their technicians) to diagnose, maintain and repair their products. They’ve done this by using Copyright Act protections in ways that were never intended.
If your repair technician is complaining about an exorbitantly priced “tool” that can only be used to access the software of one brand of product, or you are being warned that fixing a product in a local (rural) shop will void your warranty forcing you to drive several hours to a dealer, or any other product diagnosis, maintenance and/or repair issue that seems unreasonably priced… Bill C-244 is designed to turn the tide.
I grew up on a farm, where we repaired everything using whatever parts and tools we could find (I’m certain that the TV show “MacGyver” was based on a farmer). Now just imagine how frustrating it is for a farmer to be prevented from fixing an essential piece of equipment in the midst of a harvest, and having to wait several days for a “technician” to arrive to do what the farmer could have done, but was prevented simply because it would void the warranty on a $400,000 piece of equipment.
Many jurisdictions across the world have been moving much more swiftly to address issues related to #RightToRepair. I have great respect for MP @_BryanMay who, while helping a friend to fix their broken appliance, discovered the problem that this Bill is designed to address. His original Bill died on the Order Paper in the last Parliament. That’s when Brian’s colleague, @WilsonMiaoRC, picked it up and shepherded it through the House in this Parliament. It’s now my job to help my Senate colleagues to understand the importance of this very specific legislative change, enabling its swift passage into law.
#CompetitionMatters in ways that most of us never fully appreciated, and it sure is wonderful to see the issue is finally being prioritized in Canada. Happy New Year indeed! There is lots more to do, so I’m thrilled to see progress and growing momentum.
