NSW District Court Judge Michael McHugh has ruled that the viral video showing former Bankstown Hospital nurses Sarah Abu Lebdeh, 27, and Ahmad Rashad Nadir, 28, telling Israeli influencer Max Veifer that they would refuse to treat Israeli patients, send them to "Jahannam" (hell), and "kill" them, cannot be used as evidence at trial because it was recorded without the participants' consent.
The footage, filmed while the pair were in nursing uniforms during a night shift at Bankstown Hospital, went viral worldwide in February 2025 and sparked outrage in Australia and abroad.
Both nurses were removed from their positions, barred from practicing nursing, and later charged. Abu Lebdeh and Nadir have pleaded not guilty to using a carriage service to menace, harass or offend. Abu Lebdeh also faces a separate charge of threatening violence against a group.
The trial is scheduled for late August 2026. The prosecution has now lost the video that formed the basis of the evidence and brought the case to international attention.
